Alternative punishments in the Czech Republic

Abstract:

Bakalářská práce se zabývá alternativními tresty v českém právním systému. Tedy těmi, které nejsou spjaty se samotným výkonem trestu odnětí svobody ve věznici. Práce je strukturována do dvou částí, a to na část teoretickou a praktickou. V první části jsou definovány klíčové pojmy (trestný čin, účel trestu, probace a mediace, restorativní justice). Zaměřuje se na prezentaci konkrétních alternativních trestů, které jsou využívány v České republice. V těchto podkapitolách jsou jednotlivé druhy alternativních trestů detailněji rozebrány. Tato část poskytuje teoretický rámec, na který navazuje část druhá. V praktické části jsou pak představeny výsledky dotazníkového šetření, které zjišťovalo povědomí veřejnosti o alternativních trestech, názory oslovených respondentů na vhodnost ukládání alternativních trestů jednotlivým typům pachatelů. Výsledky šetření jsou znázorněny pomocí grafů. Dále je tato kapitola věnována šesti konkrétním případům jednotlivých typů pachatelů ze současné justiční praxe. S ohledem na výsledky dotazníkového šetření jsou v závěru navrhnuta opatření, která by měla danou problematiku řešit.

Abstract:

The bachelor thesis deals with alternative punishments in the Czech legal system. That is, those that are not connected with the execution of the sentence of deprivation of liberty in prison. The work is structured into two parts, namely a theoretical and a practical part. In the first part, key terms are defined (crime, purpose of punishment, probation and mediation, restorative justice). It focuses on the presentation of specific alternative punishments that are used in the Czech Republic. In these subsections, individual types of alternative punishments are discussed in more detail. This section provides the theoretical framework that is followed by the second section. In the practical part, the results of a questionnaire survey are presented, which ascertained the public's awareness of alternative punishments, the opinions of the respondents on the appropriateness of imposing alternative punishments for individual types of offenders. The results of the survey are shown using graphs. Furthermore, this chapter is dedicated to six specific cases of types of offenders from current judicial practice. Taking into account the results of the questionnaire survey, measures are proposed in the conclusion, which should solve the issue of the given issue.
