Europeanization of constitutional courts - case of the Constitutional Court of the Czech Republic

Abstract:

Práce usiluje o konceptuální uchopení evropeizace ústavních soudů, neboť se jedná o doposud opomíjenou oblast vědeckého zkoumání. Nejprve se práce zaměřuje na organizační změny v administrativní struktuře Ústavního soudu, stejně jako na proces jmenování soudců Ústavního soudu. Následně jsou diskutovány a porovnány vztahy Ústavního soudu k Nejvyššímu soudu a Nejvyššímu správnímu soudu a práce se věnuje taktéž postavení Ústavního soudu v dělbě moci. Jako jednou z nejdůležitějších oblastí se zabývá zejména vztahem Ústavního soudu a Soudního dvora EU a jejich dialogem, stejně jako "evropskou" judikaturou Ústavního soudu. V každé z výše uvedených oblastí je zkoumáno, do jaké míry se evropeizace projevuje.

Abstract:

The thesis seeks to conceptualize the europeanization of constitutional courts as it has been neglected sphere of interest of scholars so far. Firstly, the thesis aims at organizational changes in the administrative structure of the Constitutional court and appointment of judges of the court. Consequently, the mutual relations between Constitutional court and Supreme court or Supreme Administrative court are discussed and compared. Thirdly, the thesis deals with the position of Constitutional court in the separation of powers, and last, it focuses mainly on the Constitutional court's dialogue with the Court of Justice of the EU and the "European" practice of Constitutional court. The level of europeanization is examined in every of afore-mentioned research fields.
