Abstract:

Tato diplomová práce se zabývá analýzou Anti-Money Laundering (AML) právní úpravy neboli opatřeními proti legalizace výnosů z trestní činnosti a financování teroris-mu a transpozice zákonů do českého práva. V práci je posouzeno, zda současná právní úprava AML v České republice je dostatečná k ochraně finančního sektoru proti praní špinavých peněz a financování terorismu. Práce se dále zaměřuje na hodnocení dopadů nové AML právní úpravy na finanční instituce a další povinné osoby, včetně přehledu jiných zákonů, které jsou spojeny s plněním regulatorních požadavků. Práce také zkoumá otázky ochrany osobních údajů v souvislosti s AML právní úpravou. Výsledky analýzy provedené v práci ukázaly, že oblasti AML je v neustálém vývoji a lze očekávat, že tento vývoj bude pokračovat i nadále. V diplomové práci byly provedeny rozhovory s AML specialisty, kteří poskytli cenné informace a názory na téma AML a jeho transpozice do českého práva. Tyto rozho-vory poskytly důležitý přínos pro výzkum a analýzu této oblasti, a pomohly také lépe porozumět praktickým výzvám a problémům, se kterými se finanční instituce a další po-vinné osoby potýkají při plnění požadavků AML. Výsledky rozhovorů poskytly zajímavé náhledy na postoj odborníků v této oblasti a přispěly k lepšímu pochopení významu AML pro finanční sektor a ochranu proti finančním zločinům. Zároveň bylo zjištěno, že nové předpisy proti praní špinavých peněz a financování terorismu určitě přispěly k lepší transparentnosti a větší bezpečnosti plateb.

Abstract:

This thesis focuses on the analysis of the Anti-Money Laundering (AML) legal framework, which includes measures to combat money laundering and terrorist financing, as well as the transposition of laws into Czech law. The thesis assesses whether the cur-rent AML legal framework in the Czech Republic is sufficient to protect the financial sector from money laundering and terrorist financing. Furthermore, the thesis examines the impact of the new AML legal framework on financial institutions and other obligated entities, including an overview of other laws associated with regulatory compliance re-quirements. The thesis also explores issues related to personal data protection in the con-text of AML legal framework. The analysis carried out in the thesis revealed that the AML area is constantly evolving and is expected to continue to develop in the future. In the thesis, interviews were conducted with AML specialists who provided valu-able information and opinions on the topic of AML and its transposition into Czech law. These interviews provided an important contribution to the research and analysis of this area, and also helped to better understand the practical challenges and issues that finan-cial institutions and other obliged entities face in meeting AML requirements. The results of the interviews provided interesting insights into the views of experts in this field and contributed to a better understanding of the importance of AML for the financial sector and protection against financial crimes. At the same time, it was found that new regula-tions against money laundering and terrorist financing have certainly contributed to greater transparency and security of payments.
