Role of Ombudsman in a Modern Democratic Society - from an Aministrative to a Human-Rights Concept. An Analysis of its Evolution.

Abstract:

Práce odpovídá na otázku, do jaké míry a v jakých mezích se může a má ombudsman, respektive veřejný ochránce práv, zabývat ochranou základních práv a svobod. Zabývá se vymezením ochráncovy věcné působnosti ve vztahu k lidským právům v českém zákoně o veřejném ochránci práv i v předcházejících verzích návrhu zákona. Odpovídá na otázku, zda je možno ochránce při ochraně lidských práv považovat za konkurenta Ústavního soudu a zda je třeba se obávat rozdílných konkurenčních stanovisek v jedné věci. Poukazuje na to, jak úkoly ochránce, uložené mu nově dvěma novelizacemi zákona, proměňují charakter instituce. Práce je doplněna čtyřmi podrobnými kazuistikami, které základní teze dokumentují. Zvolené téma je zasazeno do širšího kontextu mezinárodní a evropské institucionální ochrany lidských práv.

Abstract:

This dissertation responds to the following question: To what extent and within what limits can and should the ombudsman (the Public Defender of Rights) be concerned with the protection of fundamental rights and freedoms? The dissertation reviews the definition of the Defender’s actual activities in relation to human rights as described in current Czech legislation on the Public Defender of Rights and in previously proposed versions of that legislation. The dissertation also addresses the question of whether the Defender should be considered a competitor to the Constitutional Court in the matter of human rights protections, as well as whether it is necessary to be concerned when the ombudsman and the Constitutional Court issue different, competing standpoints on one and the same matter. The dissertation demonstrates that the tasks assigned to the Defender by two recent legislative amendments are transforming the nature of that institution and includes four detailed case studies documenting this basic thesis. Finally, the entire topic is also placed in the broader context of the international and European institutions for human rights protection.
