The Development of the Judicial System

Abstract:

Moje diplomová práce se zabývá problematikou vývoje soudnictví 2. poloviny 19. století. Pro vývoj soudní soustavy byl významným historickým mezníkem r. 1848, kdy došlo k oddělení soudnictví od státní správy. Pro objasnění a lepší pochopení problematiky se nejprve snažím vysvětlit pojem soudnictví a jeho základní rysy v moderním státě. Dále se zaměřuji na nejdůležitější pojmy související s tématem. Práce je zaměřena na vývoj soudní soustavy v oblastech civilního, trestního a specializovaného soudnictví a její postupné proměny v průběhu daného období. Ve své diplomové práci se také zabývám personálním obsazením soudu.

Abstract:

My thesis deals with the issue of the development of judiciary in the second half of the 19th century. A significant historical milestone for the development of judiciary was the year 1848, when the judicial system was separated from the state administration. For clarification and better understanding of these issues, I first attempted to explain the notion of judiciary and its basic features in the modern state. Further I focused on the most important notions related to the topic. The work is centered on the development of the judicial system in the areas of civil, criminal and specialized justice and its gradual transformations during the given period. In my thesis, I also dealed with staffing of the court.
