Denial of Paternity

Abstract:

Tato diplomová práce se zabývá otázkou popírání otcovství. Podrobně rozebírá současnou pozitivně právní úpravu v České republice doplněnou o výklad tuzemských soudů. Cílem této práce je představit současnou úpravu institutu popírání otcovství v České republice s pohledem pro futuro. Za účelem celistvého pohledu na tuto problematiku je zde rozebírán i pohled Evropského soudu pro lidská práva a právní úprava popírání otcovství v Německé spolkové republice a Slovenské republice. Práce se zabývá i zájmem dítěte v otázkách určování a popírání otcovství. Především pak při rozhodování o prominutí zmeškání popěrné lhůty. Závěrem práce je rozebírán pohled de lege ferenda, kde jsou vytyčeny zásadní nedostatky v současné právní úpravě a nastíněn jejich možný další vývoj.

Abstract:

This thesis aims to examine the denial of paternity and to analyse the positive law and case law of the Czech Republic. The goal is to present the current legislation concerning paternity denial and its pro futuro implications. To fully analyse this issue, the legislation is examined in comparison with the case law of the European Court of Human Rights and the paternity denial legislation of the Federal Republic of Germany and the Slovak Republic. The thesis further examines the idea of the child's best interest regarding paternity establishment or denial, especially when deciding to waive the denial period. The last part of this thesis analyses the issue de lege ferenda. It defines the gaps in the current legislation and their possible development.
