Crowdfunding in Czech Law

Abstract:

Tato práce se věnuje crowdfundingu, novému způsobu financování, který získává stále na větší oblibě. Účelem práce je zhodnocení právní úpravy skupinového financování, a to jak na úrovni EU, tak v České republice. Práce dále analyzuje nejen aktuálně účinnou legislativu týkající se crowdfundingu, ale zabývá se rovněž úpravou, která začne být na území EU účinná v průběhu roku 2021, a která se jakožto první legislativní akt EU věnuje přímo crowdfundingu. Cílem práce je posouzení, zdali je crowdfunding dostatečně právně regulován, popřípadě poukázat na nedostatky této regulace.

Abstract:

This thesis deals with crowdfunding, a new way of financing which is becoming increasingly popular. The purpose of this thesis is to evaluate the legislation on crowdfunding, both in the European Union and in the Czech Republic. The paper analyses not only the currently effective legislation concerning crowdfunding, but also deals with the law that will come into force in the EU in 2021 and which, as the first legislative act of the EU, deals with crowdfunding. The aim is to assess whether the regulation of crowdfunding is sufficient, and possibly point out the shortcomings of this regulation.
