Abstract:

Pro moji diplomovou práci jsem si zvolila téma Probační a mediační služba (PMS). Zajímám se o trestní právo a při vypracování se mohu opírat o poznatky, které jsem získala z vykonané měsíční stáže na středisku PMS v Chomutově. Přestože PMS vstoupila do 12 roku své existence, v očích veřejnosti je stále pojmem poněkud neznámým. Cílem zkoumání diplomové práce je přiblížit účinnost střediska PMS, zmapovat náplň jeho činnosti a popsat způsob jeho fungování. Práce se zaměří na přínos tohoto zařízení a zhodnotí četnost ukládání trestu domácího vězení. Podstatné je, aby probace a mediace se dostala do povědomí lidí a tím se stala známější a používanější. V diplomové práci se nejdříve zaměřím na objasnění pojmů probace a mediace, následně na základní charakteristiku Probační a mediační služby – kdo PMS řídí, kdo je jejím zaměstnancem a jaké jsou cíle PMS. Dalšími kapitolami jsou činnost a působení PMS – kdy PMS sleduje a kontroluje chování obviněného s cílem, aby vedl v budoucnu řádný život, působnost této služby je vymezena v souladu s úpravou obsaženou v trestním zákoníku a trestním řádu. Následuje kapitola se kterými orgány PMS spolupracuje. Dále se zaměřuji na vysvětlení pojmu trest, jaké jsou druhy alternativních trestů. Největší pozornost věnuji trestu domácího vězení. Poslední kapitola se týká problematiky mladistvého pachatele ve vztahu k PMS.

Abstract:

I chose the topic of Probation and Mediation Service (PMS) for my thesis. I am interested in criminal law and when working on the thesis I could draw from experience and knowledge I had gained during a one-month internship done at the PMS center in Chomutov. Although the PMS has entered the 12th year of its existence, it is still quite an unfamiliar concept for general public. Aim of the thesis research is to explain the effectiveness of the PMS centers, to map scope and contents of their activities and to describe how they operate. The work focuses on the benefits this institution brings. The paper also comments on and evaluates the frequency of house arrest sentencing. The thesis first focuses on the clarification of the terms of probation and mediation, then gives the basic characteristics of the Probation and Mediation Service specifying who manages and controls the institution, who are its employees and what the objectives of PMS are. Other chapters describe the activities and operations of the PMS. The sections look at when and how PMS monitors and controls the behavior of the defendant so that she can lead an orderly life in the future. Furthermore, the scope of the service is defined in accordance with the provisions of the Criminal Code and the Criminal Procedure Code. The following chapters describes authorities and institutions cooperating with the PMS and they also focus on explanation of the notion of punishment and existing types of alternative punishment. Most attention is paid to a house arrest. The last chapter concerns the issue of juvenile offenders in relation to the PMS.
