The European Social Charter, the Council of Europe fundamental document on the social issues and its implementation in the legal system of the Czech Republic

Abstract:

Diplomová práce představuje základní dokument Rady Evropy v sociální oblasti. Pojednávám v ní o významu Evropské sociální charty a její struktuře. Věnuji se okolnostem ratifikace a úskalím procesu implementace ustanovení Evropské sociální charty do českého právního řádu. Teoretickou část uzavírám vymezením etap procesu hodnocení ve vztahu k plnění Charty. Komentuji Závěry Evropského výboru pro sociální práva a Vládního výboru pro Evropskou sociální chartu, které vycházejí ze zpráv o plnění Charty poskytnutých Českou republikou. Praktická část se věnuje náhledu studentů na Evropskou sociální chartu. Zjišťuji, zda a za jakých okolností o ní získali respondenti informace a jak vnímají její zařazení do českého právního řádu.

Abstract:

This graduation thesis introduces the basic document of the Council of Europe in the social field. It deals with the structure of the European Social Charter and its importance. I follow the conditions of ratification and the difficulties in the process of implementation the enactment of the European Social Charter into the Czech system of law. Theoretical section is finished by the phases of the process of evaluation in relation to the observance of the Charter. I comment the Conclusions of the European Committee of Social Rights and the Governmental Committee of the European Social Charter, which result from the reports on the observance of the Charter provided by the Czech Republic. The practical section follows the students? opinion of the European Social Charter. I find out whether and in which situation the informants acquired the information and how they evaluate its integration into the Czech system of law.
