The right of access to information from medical records

Abstract:

V této diplomové práci autorka zaměřuje svou pozornost na poskytnutí uceleného přehledu osob a subjektů, které mají právo přístupu k informacím ze zdravotnické dokumentace. V teoretické části práce jsou zmíněny všeobecné náležitosti, které se týkají zdravotnické dokumentace a přístupu k ní. Teoretická část práce je rozdělena na kapitoly podle charakteru subjektů s právem přístupu k informacím ze zdravotnické dokumentace. Druhá část diplomové práce je praktická. Obsahuje srovnání interních metodik několika nemocnic v České republice, které se týkají nakládání se zdravotnickou dokumentací a jejich platnosti v souladu s právními předpisy. Stěžejními kapitolami praktické části jsou metodické pokyny, které jsou zaměřeny na lékaře a pacienta. Tyto metodiky poskytují dva různé pohledy na problematiku uplatňování práva na informace ze zdravotnické dokumentace a jsou vytvořeny tak, aby mohly být použity i jako samostatné celky vně této diplomové práce. Metodiky byly vyhotoveny na základě znalostí získaných z teoretické části diplomové práce. Diplomová práce vychází ze stavu právních předpisů ke dni 30. září 2013.

Abstract:

The attention of this thesis is aimed to provide comprehensive list of persons and entities that have the right to access the information from patients' medical records. The theoretical part of this work mentions requirements relating to medical records and access to it in general. Each following chapter of the theoretical part is divided by the character of the entities with the right to information from patients' medical records. These chapters include details which are specific to these entities. The second part of this thesis contains practical use of gained information from previous part. There is a comparison of several internal methodologies obtained from Czech hospitals, which are aimed at the management and access of medical records. These methodologies are compared with applicable law. At the core of the practical part of this theses are two methodologies which were compiled from knowledge gained from theoretical part. These methodologies provide two different views on the issue of the right to information from patients' medical records – one aimed at health care professional and the second at the patient. Methodologies are designed to be used as a separate units outside of this thesis. These methodologies have been developed based on knowledge gained from the theoretical part of the thesis . This thesis is based on recent state of Czech law on September 30th 2013.
