Abstract:

Úvod: Diplomová práce se zabývá problematikou smlouvy o péči o zdraví. Cíl práce: Diplomová práce si klade za cíl přiblížit čtenáři smlouvu o péči o zdraví, tento smluvní typ rozčlenit na jednotlivé části a ty následně podrobit kritické analýze, včetně rozboru skutečnosti, jaké další obecně závazné právní předpisy do uvedeného smluvního typu mohou vstoupit. Metodika: Práce se věnuje rešerši a komparaci odborné literatury. Kritériem pro výběr byla souvislost s právy, povinnostmi a sankcemi ošetřovaného a poskytovatele péče o zdraví. Následuje tematická analýza a dílčí výzkumné šetření provedené ve formě kvantitativního průzkumu na téma, jaké je povědomí o smlouvě o péči o zdraví. Zároveň autor vytvořil vzor smlouvy. Analýzou obecně závazných právních předpisů a odborné literatury je provedena syntéza s identifikací hlavního tématu s přestupem do komparace občanského zákoníku a zdravotnického zákona. V kapitole právní odpovědnosti je provedena komparace s rakouským a německým právním řádem a nastíněna judikatura českých soudů v oblasti právní odpovědnosti za škodu. Výsledky: Mimo hlavní cíl byl pro potřeby zmapování výchozí pozice při komparaci v oblasti zdravotnického práva zhotoven kvantitativní výzkum o povědomí stran práv a povinností poskytovatele a ošetřovaného. Dotazník vyplnilo celkem 1300 respondentů, přičemž 19,4 % z nich zodpovědělo, že jsou zdravotníci a 90 % z uvedeného celkového počtu respondentů poskytuje péči o zdraví. 91,3 % z nich se poté domnívá, že jim schází povědomí o právní úpravě jejich oboru. 94,5 % z celkové počtu respondentů uvádí, že neví, jaký obecně závazný právní předpis jejich práva a povinnosti reguluje, přičemž žádný z respondentů nebyl s to sdělit přesný název předmětného obecně závazného právního předpisu. Závěr: Komparací a analýzou obecně závazných právních předpisů bylo zjištěno, že do smluvního vztahu mezi poskytovatelem a ošetřovaným vstupuje velké množství obecně závazných právních předpisů, a to zejm. zákonů a podzákonných právních předpisů. Dílčím výzkumným šetřením bylo též zjištěno, že odborná veřejnost disponuje malým povědomím o právní problematice v péči o zdraví, konkrétně pak o smlouvě o péči o zdraví. Výstupem této diplomové práce jsou poté autorem vytvořené informační webové stránky a možnost konání odborných seminářů.

Abstract:

Introduction: This diploma thesis focuses on the topic of health care contracts. Objective of the thesis: This thesis aims to inform the reader about the health care contract, to divide this type of contract into its individual parts and then subject them to a critical analysis, including the fact that other generally binding legal regulations may form a part of this type of contract. Methodology: The thesis is devoted to a search and comparison of the professional literature. The selection criteria were related to the rights, obligations and consequent penalties of the patient and the health care provider. There follows a themed analysis and sub-research conducted in the form of a quantitative survey to determine awareness of the health care contract. The author has also created a sample contract. Analysis of the generally binding legal regulations and professional literature results in a synthesis of that identifies the main topic and goes on to compare the Civil Code and the Health Act. The section on legal responsibility presents a comparison with the Austrian and German legal system and outlines the jurisprudence of the Czech courts as regarding legal damage liability. Results: In addition to the main objective, quantitative research was carried out on the parties' awareness of the provider and the patient's rights and obligations in order to map the starting position in the comparison in the field of health law. The questionnaire was completed by a total of 1,300 respondents, 19.4% of whom answered that they were health professionals and 90% of the total number of respondents providing health care. 91.3% of them then believe that they lack awareness of the laws relating to their field. 94.5% of the total number of respondents state that they do not know which generally binding legal regulation covers their rights and obligations, while none of the respondents was able to state the exact name of the generally binding legal regulation in question. Conclusion: A comparison and analysis of the generally binding legal regulations showed that a large number of generally binding legal regulations, especially laws and secondary legal regulations, play a part in the contractual relationship between the provider and the patient. A sub-research investigation also found that the professional community has little awareness of the legal side of health care, specifically health care contracts. The output of this diploma thesis is the information website created by the author and the possibility of holding professional seminars.
