Application of the Public Procurement Act in practice

Abstract:

Tato bakalářská práce se zaměřuje na problematiku zadávání veřejných zakázek s ohledem na uplatňování principů hospodárnosti, efektivnosti a účelnosti po zavedení závazných technických standardů úklidových služeb v roce 2019. Práce je rozdělena do dvou hlavních celků. Teoretická část práce objasňuje základní pojmy z oblasti zadávání veřejných zakázek, legislativní rámec technických standardů úklidových služeb a principy 3 E. Praktická část se pak zabývá hodnocením přínosu technických standardů v praxi zadávání veřejných zakázek na externí dodavatele úklidových služeb. Praktická část práce je postavena primárně na rozhovorech s 10 respondenty z české státní správy, jež jsou povinni se technickými standardy při zadávání veřejných zakázek řídit. Závěr práce obsahuje návrh na úpravu znění (tzv. “policy recommendations”) technických standardů tak, aby odpovídaly požadavkům zadavatelů, kteří standardy v praxi užívají.

Abstract:

This bachelor's thesis focuses on the issue of public procurement with regard to applying the principles of 3 E – economy, efficiency and effectiveness – after the introduction of technical standards for cleaning services in 2019. The thesis is divided into two main parts. The theoretical part of the thesis explains the basic concepts of public procurement, the legislative framework of the technical standards for cleaning services and the principles of the 3 E's. The practical part evaluates the benefits of introducing technical standards in the practice of public procurement for external cleaning services. The practical part of the thesis is based primarily on interviews with 10 respondents from the Czech public administration, that are obliged to follow the technical standards in public procurement. The thesis is concluded by the author’s policy recommendations on the amendments of the technical standards to meet the needs of contracting authorities using the standards in their day-to-day practice.
