The legal status of the child in relation to the registered partnership

Abstract:

Předmětem této diplomové práce je problematika nezletilých dětí žijících v registrovaném partnerství. Přijetí zákona o registrovaném partnerství provázela trnitá cesta, kdy byl v roce 2006 i přes veto prezidenta Václava Klause přijat. Práce se věnuje charakteristice registrovaného partnerství a jeho srovnání s institutem manželství. Především je soustředěna na odlišnosti, kterými se tyto dva instituty liší. Dále je celá kapitola věnována dětem v registrovaném partnerství, kdy se soustředí především na možnost individuálního osvojení biologického dítěte svého partnera. Soužití dětí a registrovaných partnerů je porovnáváno s řadou evropských zemí. Jako řešení otázky právního postavení dítěte v registrovaném partnerství se nabízí umožnit podstoupení asistované reprodukce lesbickým ženám v České republice, aby nebyly nuceny podstupovat tento zákrok v zahraničí. Otázka společné adopce homosexuály rozděluje společnost na dva tábory, kdy má své podporovatele, ale i zapřísáhlé odpůrce. V této době si může homosexuální osoba osvojit dítě, avšak nesmí být v registrovaném partnerství. Domnívám se, že ustanovení vylučující adopci registrovaným partnerství odporuje Evropské úmluvě o ochraně lidských práv a základních svobod. S ohledem na to, že vstup do registrovaného partnerství neruší již vzniklé osvojení, přijde mi toto ustanovení pouze jako donucování homosexuálních osob k jakémusi "obcházení zákona", aby si nejprve dítě osvojili v individuální adopci, a až poté následně vstoupili do registrovaného partnerství.

Abstract:

The subject of this thesis is the issues of minors who live in the registered partnership. "Torny path" was gone along by the admission of the Registered Partnership Act. It was accepted in 2006 despite veto of Václav Klaus . The work is pursued the characteristic of the registered partnership and its comparison with marriage institute. Especially it is concentrated on the differences which these institutions differ. Below is an entire chapter devoted to the children in the registered partnership, when it is concentrated on the possibility of individual adoption of the biological child of his other partner. The coexistence of the children and the registered partners is compared with other European c ountries. There is an offer to enable the undergo of the assisted reproduction by lesbian woman to not to be constrained this intervention abroad as the solution of the legal questions of the status of the child. The question of the joint homosexual adoption divided the society into two camps when there are supporters and sworn opponents. At this time the homosexual person can adopt the child but he or she needn't to be in the registered partnership. I think that provision excluding registered partners adoption contravenes the European Convention for the Protection of Human Rights and Fundamental Freedoms. Given that entry into a registered partnership does not disturb already incurred adoption, it seems to me, this provision only as coercion gay people to such "circumvention" to adopt a child in individual adoption at first and until then to enter into the registered partnership.
