Labour - law Relations of the Employees in the education resort

Abstract:

Práce se ve své struktuře zaměřuje nejdříve na samotné vymezení pojmů pracovněprávní vztahy, zaměstnanci ve školství, systém a správa školství v České republice. Podrobněji rozebírá jaké jsou orgány státní správy na úseku školství, jejich postavení, úkoly, smysl a pravomoci. Ve stejném duchu pak práce totéž rozebírá i u orgánů samosprávy na úseku školství. Poté se práce v samostatné a nejobsáhlejší kapitole věnuje jednotlivým pracovněprávním vztahům zaměstnanců ve školství z hlediska jejich vzniku, změny a zániku. Tato kapitola je prokládána konkrétními příklady z praxe a citacemi ze soudních rozhodnutí. Právní úprava pracovněprávních vztahů v České republice je zde poté srovnávána se zahraniční právní úpravou Slovenské republiky a Spolkové republiky Německo. Samostatnou kapitolu v práci pak tvoří téma popisů práce (pracovní náplně) pracovníků ve školství, včetně konkrétních příkladů z praxe. Následuje další z kapitol práce, která se věnuje pracovněprávním nárokům zaměstnanců školství z pracovního poměru. Práci tématicky uzavírá rozbor problematiky sdružování zaměstnanců školství v odborových organizacích. Po právní stránce je rigorózní práce uzavřena ke dni 30. 6. 2008.

Abstract:

The work focuses in its structure firstly on the definition of terms labour-law relations, employees in education, system and administration of education in the Czech Republic. There is a more detailed analysis of the bodies of the civil service of the education sector, their position, tasks, purpose and competences. In the same style the work analyses the same set of features of the bodies of self-government in the education sector. Afterwards, in the separate and the most comprehensive chapter, the work deals with the individual labour-law relations of the employees in the education in terms of their creation, change and extinction. This chapter is interlaced with actual practical examples and citations from the adjudications. Legal regulations of the labour-law relations in the Czech Republic are here compared with the foreign regulations of the Slovak Republic and the Federal Republic of Germany. An individual chapter in the work comprises of the descriptions of the work (work requirements) of the employees in the education including practical examples. Following is the chapter dealing in its entirety solely with the labour-law demands laid on the employees by the employment. The work is thematically concluded by the analysis of the problems of association of the employees of the education in the trade unions. In terms of law, the rigorous work is concluded for the date of 30th June 2008.
