The EU competence to regulate a healthy diet

Abstract:

Diplomová práce se zabývá pravomocí Evropské unie regulovat zdravou stravu v členských státech. Evropská unie není přímo kompetentní k regulaci zdravé stravy, proto využívá podpůrně institutů veřejného zdraví, ochrany spotřebitele a vnitřního trhu. Práce je rozdělena na teoretickou a praktickou část. Teoretická část je založena na rozboru právního základu, právních nástrojů a institucionálního zajištění regulace zdravé stravy v Evropské unii. V praktické části autorka analyzuje a porovnává dva judikáty Soudního dvora Evropské unie. V obou případech se jedná o řízení o nesplnění povinnosti. Na základě zjištěných skutečností diplomová práce uvádí návrhy regulace zdravé stravy pro členské státy v souladu s právem EU.

Abstract:

The master thesis deals with the EU competence to regulate a healthy diet. The European Union is not directly competent to regulate a healthy diet, so it uses the institutions of public health, consumer protection and the internal market in support. The work is divided into theoretical and practical part. The theoretical part is based on the analysis of the legal basis, legal instruments, and institutional provision of a healthy diet regulation in the European Union. In the practical part, the author analyses and compares two judgments of the Court of Justice of the European Union. Both cases are infringement proceedings. Based on the findings, the thesis presents proposals for the regulation of a healthy diet for the member states in accordance with the EU law.
