Criminal offence of drunkeness in \S~201a of Criminallaw

Abstract:

Práce vychází ze základní charakteristiky trestného činu opilství podle ust. § 201a trestního zákona, přičemž nechybí historický vývoj tohoto institutu. Jádrem je pak důkladná charakteristika skutkové podstaty tohoto deliktu se zaměřením na možná specifika jejích jednotlivých znaků. Následuje rozbor konstrukce actio libera in causa a jeho teoretická východiska. Samostatná kapitola je věnována problematice vlivu návykových látek na osobu pachatele včetně posuzování alkoholové a jiné toxikomanie. Dále se práce zabývá specifiky některých procesních aspektů, zhodnocením současného právního zakotvení v komparaci s německým a vrcholí rozborem nové úpravy v již platném novém trestním zákoně včetně úvah de lege ferenda. Práce je samozřejmě zakončena závěrem, následuje seznam použité literatury, judikatury a všech pramenů

Abstract:

This diploma work is based on essential characterization of criminal offence of intoxication according to § 201a of penal code. The first part consists also of historical legislative development of this offence. Complete characterization of body of the crime with concentration on its possible specific aspects is the main attention of this work. The following chapter analyses the construction of concept called "actio libera in causa" including its theoretical analysis. The treatise about problems with affects of addictive substances we can find in the next part of the work. The diploma work is also interested in specialities of some procedural aspects, critical improvement of recent mandatory regulation and comparation with German legislative regulation. The work culminates with anylysis of regulation of this offence in the new Czech penal code that has come into force recently, and including consideration of legislative regulation in the future. Naturally, component parts of the work are conclusion, list of used literature, judicial decisions and all sources of students research
