Abstract:

Práce je na téma tresty a ochranná opatření. Je zde zpracován historický vývoj od roku 1961 a srovnání se současnou právní úpravou. Vysvětlení pojmu trestu a ochranného opatření, vyjmenovány zásady a kritéria pro jejich ukládání a instituty upuštění od potrestání a zánik trestu. V práci je popsána systematika těchto sankcí a také ukázání možnosti trestání mladistvých. Vysvětluje pojem alternativní tresty a možnost jejich uložení při rozhodování soudů.

Abstract:

This final work is about topic punishments and protective measures. The historic evolution since the 1961 and comparison with an actual legislation is processed here. There is also an explanation of notion punishment and protective measure. Principles and criteria of their imposing and also the notion punishment abandonment and extincion of punishment are placed here.In this final work the system of sanctions and punishing of juveniles are described here. The work explains the notion of alternative punishment and shows a posibility to impose punishment during the court decisions
