The application of the ne bis in idem principle in criminal law

Abstract:

Práce se zabývá zásadou ne bis in idem a její aplikací v trestním právu. Zásada ne bis in idem je v pramenech práva vnitrostátního i mezinárodního tradičně garantována jako zásada, jež se uplatňuje pouze v rámci trestní jurisdikce jednoho státu (viz čl. 14 odst. 7 Mezinárodního paktu o občanských a politických právech a čl. 4 Protokolu č. 7 k Úmluvě o ochraně lidských práv a základních svobod). V dnešní době však již nejsou ojedinělá ustanovení, která rozpoznávají mezinárodní účinky zásady ne bis in idem. V Evropě se mezistátní aplikace této zásady opírá o mezinárodní smlouvy multilaterální regionálního charakteru (například o Evropskou úmluvu o vydávání či Evropskou úmluvu o předávání trestního řízení), mezinárodní smlouvy bilaterální, právní předpisy Evropské unie (mezi všemi lze vyzdvihnout Listinu základních práv Evropské unie a Schengenskou prováděcí úmluvu) a o vnitrostátní prameny práva. Právní akty českého původu v rovině ústavní předepisují použití zásady ne bis in idem jen ohledně rozhodnutí domácích orgánů činných v trestním řízení (viz čl. 40 odst. 5 Listiny základních práv a svobod). Domácí trestní řád však předmětné zásadě přiznává také extrateritoriální účinky. V souvislosti s rozvojem mezinárodního trestního soudnictví se objevil fenomén aplikace zásady ne bis in idem v případech střetu trestní jurisdikce státu s trestní jurisdikcí specializované mezinárodní soudní instituce, popřípadě s trestní jurisdikcí soudního orgánu mezinárodní organizace. Nadnárodní uplatnění zásady ne bis in idem zaručuje Statut Mezinárodního trestního tribunálu pro bývalou Jugoslávii, Statut Mezinárodního trestního tribunálu pro Rwandu i Římský Statut Mezinárodního trestního soudu. Prozatím spíše jen teoretická možnost konfliktu několika nadnárodních trestních jurisdikcí pak poodhaluje další prostor pro uplatnění zásady ne bis in idem.

Abstract:

The thesis deals with the ne bis in idem principle and its application in criminal law. The ne bis in idem principle is in the sources of national and international law traditionally guaranteed as a principle that is applied only within the criminal jurisdiction of one state (see article 14, paragraph 7 of the International Covenant on Civil and Political Rights and article 4 of the Protocol No. 7 to the Convention on Human Rights and Fundamental Freedoms). Today, however, provisions that recognize the international effects of the ne bis in idem principle are not unique. In Europe, the international application of the ne bis in idem principle is based on international conventions of multilateral regional nature (for example on the European Convention on Extradition or the European Convention on the Transfer of criminal proceedings), bilateral international agreements, legislation of the European Union (among all it is possible to emphasize the Charter of Fundamental Rights of the European Union and the Convention Implementing the Schengen Agreement) and on national sources of law. Legal acts of Czech origin at constitutional level prescribe the use of the ne bis in idem principle only on the decisions of domestic bodies active in criminal proceedings (see article 40, paragraph 5 of the Charter of Fundamental Rights and Freedoms). The domestic Code of Criminal Procedure also gives extraterritorial effects to this principle. In connection with the development of the international criminal justice system the phenomenon of the application of the ne bis in idem principle was discovered in cases of conflicts of criminal jurisdiction of the state with criminal jurisdiction dedicated to the international judicial institution, or to the criminal jurisdiction of the judicial authority of international organization. Trans-national application of the ne bis in idem principle is guaranteed by the Statute of the International Criminal Tribunal for the Former Yugoslavia, the Statute of the International Criminal Tribunal for Rwanda and the Rome Statute of the International Criminal Court. The theoretical possibility of conflict of several trans-national criminal jurisdictions then reveals additional space for the application of the ne bis in idem principle.
