Entry of alien to the territory of the state (international, European Union and Czech law perspectives)

Abstract:

Smyslem této disertační práce bude popřít obecně rozšířenou tezi (v judikatuře, praxi států i teorii), že stát má absolutní volnost v otázkách rozhodování o vstupu cizince na své území v rámci výkonu své územní suverenity a že jedinou výjimku z tohoto pravidla představují maximálně smluvní závazky. Práce tak bude analyzovat v rámci jednotlivých pramenů mezinárodního práva, zda a popř. jaká omezení kladou na volnost států v otázkách přijímání cizinců. Lze nalézt kromě smluvního práva určité limity i v obyčejovém mezinárodním právu, popř. dokonce v kogentních normách obyčejového mezinárodního práva, zejména v zákazu rasové diskriminace a v zásadě non-refoulement, obsažené v zákazu mučení? A pokud tyto limity existují, dopadají pouze na stanovení přijímacích podmínek nebo lze nalézt dokonce takovou normu obyčejového mezinárodního práva, která při splnění určitých podmínek zavazuje stát umožnit cizinci vstup na své území? Lze v současnosti legitimně vylučovat z přístupu na území státní příslušníky jen jednoho či několika států? Lze v tomto ohledu cizince diskriminovat např. na základě rasy či z jiných důvodů? Lze vystopovat určitá specifika u dlouhodobě usazených cizinců, resp. rozdíly mezi těmito cizinci a cizinci, kteří se pokouší vstoupit na území cizího státu poprvé? Toto vše jsou otázky, na které se pokusí tato práce nalézt odpověď. Na úrovni univerzálních (zejména MPOPP, Úmluvy proti mučení, Úmluvy o právním postavení uprchlíků či Úmluvy o právech dítěte) a regionálních (zejména EÚLP a dalších smluv přijatých na půdě Rady Evropy) lidsko-právních úmluv budu analyzovat ta ustanovení, u nichž může, popř. dochází k prolomení principu volného uvážení státu v těchto otázkách. Rád bych rovněž popsal ony dramatické dopady, které má na tradiční teoretické přístupy mezinárodního práva unijní právo, založené na jedné straně na volném pohybu osob – občanů členských států EU a (s určitými specifiky) jejich rodinných příslušníků, a na straně druhé na harmonizovaném přístupu k možnostem vstupu cizinců – občanů tzv. třetích států (zejména se zaměřením na situace, kdy dochází k prolomení nenárokovosti vstupu na území i ve vztahu k určitým kategoriím těchto cizinců). Na příkladu České republiky se pak pokusím demonstrovat, že za současného stavu unijního práva je historicky většinově zastávaný postoj proklamující volné uvážení státu v otázkách přijímání cizinců spíše zbožným přáním, nežli realitou. Kromě doktrinálních přístupů bude analyzována i judikatura mezinárodních (Mezinárodní soudní dvůr v Haagu) a regionálních (Evropský soud pro lidská práva, Soudní dvůr Evropské unie, Meziamerická komise/soud pro lidská práva) soudů. Rovněž bude bohatě využita rozhodovací a monitorovací praxe jednotlivých orgánů, zřízených příslušnými lidsko-právními smlouvami (Výbor OSN pro lidská práva, Výbor pro odstranění všech forem rasové diskriminace, Výbor proti mučení či Výbor pro práva dítěte). U rozebíraných témat v neposlední řadě a ve vhodných případech poukážu na vnitrostátní právní úpravu a rozhodovací (správní i soudní) praxi, s občasným využitím konkrétních kazuistik z šetření podnětů veřejným ochráncem práv. Kapitola 2 stručně pojednává o definici cizince v mezinárodním právu. Kapitola 3 mapuje teoretické přístupy domácí literatury mezinárodního práva k přijímání cizinců od dob První republiky do současnosti. Kapitola 4 podává historický exkurz teoretických i praktických přístupů k přijímání cizinců od dob Starého zákona až do 19. století s tím, že jádro této kapitoly tkví v analýze teoretických přístupů k

lasiků mezinárodního práva (zejména E. de Vatella, jehož vliv je patrný až do současnosti) ve snaze dokázat, že tito autoři nestojí na pozici absolutní volnosti státu ve vztahu k přijímání cizinců. Kapitola 5 analyzuje základní teoretické přístupy k přijímání cizinců na ose od zastánců absolutní volnosti státu v těchto otázkách až po autory, kteří nachází v mezinárodním právu ničím neomezené právo cizince na vstup na území. V rámci této kapitoly bude vzpomenuta i judikatura soudů USA a Spojeného království k přijímání cizinců z poslední čtvrtiny 19. století, která zásadně ovlivnila veškeré další rozhodování soudů po celém světě až do dnešních dob. Kapitola 6 usiluje vystopovat právo na vstup (trvale) usazených cizinců v mezinárodních a regionálních lidsko-právních úmluvách, zejména v čl. 12 odst. 4 MPOPP a následně pak i jejich procesní záruky obsažené v čl. 1 Protokolu č. 7 k EÚLP. Analyzována bude rovněž právní úprava vstupu této kategorie cizinců na úrovni práva EU (zejména v souvislosti s institutem odepření vstupu obsaženém v Schengenském hraničním kodexu) a její odraz na úrovni vnitrostátního práva ČR. Kapitola 7, která se zabývá diskriminací, představuje i svojí obsáhlostí jedno z těžišť této práce. Nejdříve bude analyzován čl. 26 MPOPP, který obsahuje obecný zákaz (mimo jiné) rasové diskriminace a jeho dopady na volnost státu při stanovení podmínek přijímání cizinců. Tatáž analýza pak bude provedena i ve vztahu k čl. 14 EÚLP a Protokolu č. 12 k EÚLP. Následně se budu zaobírat nejdříve obecnou existencí kogentních norem v obyčejovém mezinárodním právu a poté usilovat dokázat, že zákaz rasové diskriminace k takovým normám patří. Dále bude mojí snahou definovat dopady takového závěru na migrační politiku státu při stanovení podmínek pro vstup cizinců na území. Tato analýza bude provedena s odkazem na Vídeňskou úmluvu o smluvním právu, Návrh článků o odpovědnosti států a další relevantní zdroje (např. praxe Výboru pro lidská práva či Výboru pro odstranění rasové diskriminace, mezinárodní i vnitrostátní judikatura a názory doktríny). Obdobnému rozboru bude poté podroben i zákaz diskriminace na základě pohlaví a v závěru této kapitoly i diskriminace na základě státní příslušnosti. Státní příslušnost je totiž v praxi států nejčastějším důvodem pro stanovení odlišných podmínek vstupu pro cizince s tím, že ne vždy se musí jednat o diskriminaci. Využit bude i domácí příklad rozdílného nakládání s cizinci dle státní příslušnosti v souvislosti se zavedením kvót na dlouhodobá víza/pobyty pro některé státy a fungováním systému Visapoint. 8. kapitola bude věnována oblasti azylu a uprchlíků. Bude hledána odpověď na otázku, zda žadatel o azyl a uprchlík dle Úmluvy o právním postavení uprchlíku mají při hledání ochrany právo na vstup na území státu či nikoli. Gros této kapitoly však tkví v analýze zásady non-refoulement, obsažené v čl. 33 zmíněné úmluvy, opět s tím, zda a popř. v jakých situacích bude možné z ní dovodit právo uprchlíka na vstup. Zkoumán bude i teritoriální rozsah této zásady ve vztahu k uprchlíkům nacházejícím se na hranici státu, popř. zda se tato zásada uplatní i při udělování víza uprchlíkovi, který hledá ochranu před pronásledováním na zastupitelském úřadě. Následně bude analyzováno, zda zásada non-refoulement (v kontextu uprchlického práva) představuje (kogentní) normu obyčejového mezinárodního práva. Kapitola 9 se zabývá zásadou non-refoulement obsaženou v mezinárodních lidsko-právních úmluvách, zejména v čl. 3 EÚLP, čl. 7 MPOPP, čl. 3 Úmluvy proti mučení a čl. 37 Úmluvy o právech dítěte, a jejími dopady na přijímání cizinců. Zkoumány budou zejména situace, za kterých její uplatnění vyvolává závazek státu umožnit cizinci vstup na své území a její extrateritoriální aplikace (ve vztahu k cizinci na hranicích a cizinci, který žádá o vízum a hledá ochranu před mučením na zastupitelském úřadě). V závěru bude pojednáno o zákazu mučení jako kogentní normě obyčejového mezinárodního práva, jejíž fundamentální součástí je právě zásada non-refoulement. V kapitole 10 se budu věnovat ustanovením univerzálních (MPOPP a Úmluva o právech dítěte) a regionálních (čl. 8 EÚLP) mezinárodních úmluv, které se v nejrůznější podobě dotýkají sloučení rodiny a zda a popř. za jakých podmínek z nich bude možné dovodit právo na vstup slučujícího se rodinného příslušníka. Kapitola 11 pojednává obecně o mezinárodních smlouvách, jako nejčastějším zdroji omezení volnosti států při přijímání cizinců a kromě bilaterálních smluv se zaměřuje zejména na analýzu smluvních dokumentů přijatých na půdě Rady Evropy, které upravují přijímání různých kategorií cizinců. 12. kapitola je věnována historii a současnosti fenoménu volného pohybu osob v rámci EU jako popření tradičně postulované (absolutní) volnosti státu v otázkách přijímání cizinců. Kapitola 13 dokumentuje (prozatím neúspěšné) snahy o kodifikaci mezinárodního uprchlického práva. Závěrečná 14 kapitola pak obsahuje shrnutí a zobecnění všech relevantních dílčích závěrů obsažených v předchozích kapitolách.

Abstract:

The key objective of this dissertation is to reject the generally accepted idea (in the case law, State practice and theory) that the State has absolute discretion in the issues concerning decision-making on allowing aliens to enter its territory within the exercise of its sovereignty and that the only exemption to this rule consists in the contractual obligations. For this reason, the dissertation is going to analyse, within individual sources of international law, whether and possibly what restrictions they impose on the States’ liberty in the issues of receiving aliens. Apart from the contract law, is it possible to find certain limits in common international law, or possibly even in mandatory rules of common international law, in particular in the prohibition of racial discrimination and the non-refoulement principle contained in the prohibition of torture? And provided that such limits exist, do they affect merely determining the entrance terms and conditions or is it possible to find a rule of the common international law that upon meeting certain conditions, binds the State at allow entry to an alien to its territory? At present, is it possible to legitimately exclude the nationals of only one or several States from the entry to the territory? In this respect, it is possible to discriminate against aliens, for instance on the basis of their race or any other reasons? Is it possible to trace certain particularities in case of aliens residing in the country on a long-term basis, or the differences between these aliens and those attempting to enter the territory of a foreign State for the first time? These are all the questions that the dissertation will attempt to answer. At the level of universal (particularly the ICCPR, Convention Against Torture, Convention Relating to the Status of Refugees, or Convention on the Rights of the Child) and regional (particularly the ECHR and other treaties adopted in the Council of Europe) treaties on human rights, I am going to analyse those provisions that may (or do) violate the principle of the free discretion of the State concerning these issues. I would also like to describe the dramatic effects on the traditional theoretical approaches exercised by the EU law, which is on the one hand, based on free movement of persons – EU Member States’ nationals and (with some particularities) their family members, and on the other hand, the harmonised approach to the possibilities of entry of aliens – so-called third-country nationals (with a particular focus on the situations where there is a breach of the lack of entitlement to the entry to its territory also in relation to certain categories of these aliens). Taking the example of the Czech Republic, I will then attempt to demonstrate that given the existing state of the EU law, the approach, taken by the majority from the historical perspective, declaring the discretionary power of the State concerning receiving aliens has remained wishful thinking rather than reality. Apart from doctrinal approaches, the analysis will also cover the case law of international (International Court of Justice in the Hague) and regional (European Court of Human Rights, Court of Justice of the European Union, or Inter-American Commission / Court on / of Human Rights) courts. Furthermore, the analysis will also make use of the decision-making and monitoring practice of individual authorities, established by the relevant human rights treaties (United Nations Committee on Human Rights, Committee on the Elimination of Racial Discrimination, Committee Against Torture, or Committee on the Rights of the Child). With the help of the discussed topics and in suitable cases, I will also point out the national legislation and decision-making (both administrative and court) practice, with the occasional use of case interpretation taken from the complaints examined by the Public Defender of Rights. aw. Chapter 3 maps the theoretical approaches of the domestic literature on international law concerning receiving aliens from the era of the First Republic up to the present. Chapter 4 provides as historical outline of theoretical and practical approaches to receiving aliens from the period of the Old Testament up to 19th century, with the core of this chapter consisting of the analysis of the theoretical approaches developed by the classics of international law (in particular, E. de Vattel whose influence has remained obvious until today), attempting to prove that these authors do not promote the position of the State’s absolute discretion in relation to receiving aliens. Chapter 5 analyses the key theoretical approaches to receiving aliens ranging from advocates of State’s absolute discretion in these matters to those authors who have found no restrictions in the international law concerning the alien’s right to enter the territory. This chapter will also refer to the case of law of US and UK courts related to receiving aliens and issued in the last quarter of 19th century, which has had a crucial effect onto any further decision-making of courts all across the globe until today. Chapter 6 seeks to trace the right to enter of aliens (permanently) residing in the given country in international and regional treaties on human rights, in particular in Art. 12 of the ICCPR, and subsequently their procedural guarantees contained in Art. 1 of the Protocol No. 7 of the ECHR. The analysis will also cover the legal regulations concerning the entry of this type of aliens on the level of the EU law (particularly in relation to the institute of denying entry contained in the Schengen Borders Code) and its reflection on the level of the national law of the Czech Republic. Chapter 7, dealing with discrimination, represents one of the cornerstones of this dissertation, in part due to its comprehensiveness. At first, the analysis will focus on Art. 26 of the ICCPR containing a general prohibition of (not only) racial discrimination and its effects onto the State’s discretionary powers when determining the conditions for receiving aliens. The same analysis will then be carried out in relation to Art. 14 of the ECHR and Protocol No. 2 of the ECHR. Subsequently, I will deal with the general existence of mandatory rules in the common international law, followed by an attempt to prove that prohibiting racial discriminations falls within such rules. Furthermore, I will attempt to define the impacts of such a conclusion on the migration policy of the State when determining the conditions for aliens entering its territory. This analysis will be carried out with reference to the Vienna Convention on the Law of Treaties, Draft Articles on Responsibility of States for Internationally Wrongful Acts, and other relevant sources (e.g. the practice of the Committee on Human Rights or the Committee on the Elimination of Racial Discrimination, international and national case law, and the doctrine’s opinions). A similar analysis will then be applied onto the prohibition of sex discrimination and also, at the end of the chapter, discrimination based on nationality. In fact, nationality is, in the practice of States, the most common reason for setting different conditions of entry for aliens, maintaining that this does not necessarily amount to discrimination in all cases. The analysis will also make use of the domestic example of different treatment of aliens depending on their nationality in relation to introducing quotas for long-term visas / stays for some States and operating the Visapoint system. Chapter 8 will deal with the area of asylum and refugees. It will attempt to answer the question whether the asylum applicant and refugee pursuant to the Convention relating to the Status of Refugees have a right to enter the territory of the State or not when seeking protection. The core of this chapter lies, however, in the analysis of the non-refoulement principle, contained in Art. 33 of the afore-mentioned Convention, dealing with whether and possibly in what situations it will be possible to infer the refugee’s right to entry. The analysis will also examine the territorial scope of this principle in relation to refugees located at the State’s border, or possibly whether this principle also applies to granting a visa to a refugee seeking protection from prosecution at the embassy. This will be followed with an analysis whether the non-refoulement principle (in the context of refugee law) represents a (mandatory) rule of the common international law. Chapter 9 deals with the non-refoulement principle contained in international treaties on human rights, particularly in Art. 3 of the ECHR, Art. 7 of the ICCPR, Art. 3 of the Convention Against Torture, and Art. 37 of the Convention on the Rights of the Child, as well as its effects on receiving aliens. In particular, the analysis will examine those situations under which its application results in the State’s obligation to allow entry of the alien to its territory and its extraterritorial application (in relation to the alien at the border and the alien applying for a visa and seeking protection from torture at the embassy). The chapter is concluded with an analysis into the prohibition of torture as a mandatory rule whose fundamental component consists of the non-refoulement principle. Chapter 10 focuses on the provisions of universal (the ICCPR and the Convention on the Rights of the Child) and regional (Art. 8 of the ECHR) international treaties concerning, in various ways, the reunification of the family and whether and under what conditions they may be used to infer the right of entry for the family member to be reunified. Chapter 11 focuses, in general, on international conventions as the most frequent source of limiting the State’s discretionary powers when receiving aliens, and apart from bilateral treaties, it focuses mainly on the analysis of contractual documents adopted in the Council of Europe governing receiving various categories of aliens. Chapter 12 deals with the history and present of the phenomenon of free movement of persons within the EU as a rejection of the traditionally claimed (absolute) discretion of the State related to the issues of receiving aliens. Chapter 13 documents (so-far unsuccessful) attempts to codify the international refugee law. Finally, Chapter 14 includes the summary and generalisation of all relevant partial conclusions contained in previous chapters.
