Abstract:

Magisterská práce se zabývá srovnáním šesti vybraných soudních procesů s představiteli zakázaných spolků z doby první republiky. Tyto procesy se konaly na základě zákona č. 50/1923 Sb., na ochranu republiky. Jedná se o procesy, které se v rozmezí let 1925 až 1934 konaly proti představitelům komunistického spolku Čerkesů, maďarských spolků Levente a tzv. „Probouzejících se Maďarů“, fašistického spolku Junák, německého spolku Jungsturm a dalšího německého spolku Volkssport. Pomocí šesti komparačních kritérií práce odpovídá zejména na tyto otázky: Jak postupovaly soudy při zachovávání zákonnosti ve výše zmíněných soudních procesech? Jaké jsou shody nebo rozdíly v postojích a intervencích soudců a jednotlivých aktérů procesů? Jaký je rozdíl v mediálním a politickém ohlasu jednotlivých procesů? Jaké jsou shody nebo rozdíly v přístupu soudců z hlediska multikulturního složení obžalovaných vybraných soudních procesů? Jednalo se o politické procesy se znaky soudního divadla podobné politickým procesům z 50. let 20. století v komunistickém Československu?

Abstract:

The master thesis deals with a comparison of six selected trials with the representatives of prohibited associations from the period of the First Republic. These trials took place on the basis of the law no. 50 of 1923, as a protection of the Republic. It is about the trials, which were held between 1925 and 1934 against the representatives of the communist association of Čerkes, the hungarian associations Levente and the so called "Ébredö Magyar Egyselité", the fascist association Junák, the german association Jungsturm and another german association Volkssport. Due to the six comparative criteria, the thesis answers these questions: How the courts proceeded in maintaining the legality during the above mentioned trials? What were the agreements and differences in attitudes and interventions of judges and individual participants of the trials? What is the difference between the media and political responses of the individual trials? What are the agreements and differences in the attitudes of judges from the point of view of the multicultural composition of the defendants of the selected trials? Was it about the political trials with the signs of the court theatre similar to the political trials in 1950s in the communist Czechoslovakia?
