The Employment of Foreigners within the Context of Migration Policy

Abstract:

Cílem mé diplomové práce bylo poodkrýt problematiku zaměstnávání cizinců v České republice v souvislostech migrační politiky. Svou diplomovou práci jsem rozdělila do šesti celků (kapitol). V každé z těchto kapitol jsem se vždy snažila nastínit problematiku v teoretickém kontextu, podložit jej mezinárodními, komunitárními a vnitrostátními právními normami a následně aplikovat na praktický případ. První částí mé diplomové práce tvoří úvod. Ve druhé části jsem vymezila legislativní rámec, který je tvořen vnitrostátními právními normami, komunitárním právem a mezinárodními smlouvami v oblastech zaměstnávání cizinců, jejich pobytu a migrační politiky na území České republiky. V této části jsem se zaměřila především na jednotlivé mezinárodní smlouvy, které tuto problematiku upravují, dále na zákon č. 435/2004 Sb., zákon o zaměstnanosti a zákon č. 326/1999 Sb., o pobytu cizinců, zde jsem zohlednila příslušné novely v dané oblasti ke dni zpracování mé práce. V obou výše jmenovaných zákonech je přehledně a podrobně rozčleněna problematika občanů Evropské unie a občanů tzv. “třetích zemí,“ upravují potřebné procesně-právní postupy a subsidiaritu nového správního řádu. Ve třetí kapitole jsem popsala jednotlivé orgány státní správy na úseku zaměstnanosti se změřením na problematiku zaměstnávání cizinců. Ve čtvrté kapitole jsem se zabývala pracovněprávní ochranou cizinců a udělováním pracovního povolení občanům Evropské unie, jejich rodinným příslušníkům a cizincům tzv. “třetích zemí.“ V první podkapitole jsem popsala systematiku nového zákona o zaměstnanosti, kde jsem se zaměřila na část čtvrtou, zaměstnávání zaměstnanců ze zahraničí. V následujících podkapitole jsem popsala zásady správního práva a podrobněji rozebrala míru diskreční pravomoci správních orgánů na úseku zaměstnanosti a institut správního uvážení. Ve zbývajících podkapitolách jsem rozebrala proces získávání pracovního povolení, který je rozčleněn do dvou větších celků, dle toho, zda jsou občany EU, EHS nebo občany „třetích zemí.“ Prakticky jsem aplikovala tyto poznatky na reálný případ z praxe. Vzhledem k tomu, že cizinci u nás nepobývají v souvislosti s prací pouze jako zaměstnanci, v podkapitolu 4.6. jsem se věnovala také možnosti „podnikání cizinců v ČR.“ V páté kapitole jsem popsala problematiku a proces ověřování cizojazyčných listin a dokumentů, které jsou přikládány jakou součást žádostí o pracovní povolení, udělení pobytu a dalším případným jednáním cizince se správními úřady v České republice, jeho tři právní režimy: režim automatické použitelnosti, aspostilace a superlegalizace dokumentů. Současně jsem zde vymezila legislativní rámec k tomuto tématu. V této souvislosti zde byly rozebrány úhly pohledu několika autorů na definici pojmu veřejná listina. Tyto jednotlivé právní režimy byly aplikovány na příkladech veřejných listin, a to, rodného listu, diplomu o dosaženém vzdělání a oddacím listu, cizinců z „tzv. třetích zemí.“ V části šesté své diplomové práce jsem svou pozornost zaměřila na pobyt cizinců na území České republiky, který velmi úzce souvisí s problematikou udělování pracovního povolení, neboť je druhým nezbytným krokem k tomu, aby zde cizinec mohl svou činnost vykonávat. Tato kapitola je rozčleněna na pobyty udělované občanům Evropské unie, jejich rodinným příslušníkům a cizincům tzv. „třetích zemí.“ Opět je zde popsán případ z praxe, se kterým jsem se setkala a o své poznatky a zkušenosti jsem se tímto s vámi podělila. plomové práce jsem využila teoretického vymezení problematiky v jednotlivých mezinárodních smlouvách a právních předpisech, ale také své praxe na Cizinecké policii a Úřadu práce – oddělení cizinců v Ostravě. Současně jsem se ve své práci setkala s možností vyzkoušet si celý proces prakticky a tímto se podělit o svůj úhel pohledu ze strany druhé. Čtvrtá, pátá a šestá kapitola je vždy rozšířena o řadu praktických postupů, formulářů z praxe a příloh. Dle mého názoru je výše popsaná problematika nyní na počátku svého vývoje, postupně reaguje na stále se nově objevující podněty z praxe a téměř každý druhý případ k řešení je ojedinělý. Současně chybí dostatečné množství literatury k této problematice a komentáře k výše jmenovaným zákonům. Také získávání informací je složité a zdlouhavé, neboť nyní stojíme na počátku tzv. aplikační praxe. Napsání této diplomové práce mě velmi obohatilo, neboť jsem si po roce intenzívní práce, sbírání materiálů a praxe utřídila své myšlenky a vytvořila ucelenější představu, jakým způsobem bych postupovala v dalších obdobných případech.

Abstract:

The aim of my thesis was to disclose issues related to the employment of foreigners in the Czech Republic in the context of migration policy. The thesis is divided into six sections (chapters). In each of these chapters, I have tried my best to outline the issue in a theoretical context, to support it using international, community and national legal standards and then applied it to a practical case. The first section of the thesis is the introduction. The second part defines the legislative framework, which is created by national legal standards and international treaties regulating the employment of foreigners, their residence and migration policy in the Czech Republic. In this section I focused mainly on the individual international treaties which regulate this issue, as well as on the Employment Act No. 435/2004 Coll. and the Act No. 326/1999 Coll. on the Stay of Foreigners. On the date of compilation of the thesis, the amendments in the appropriate field were taken into account. The both above mentioned laws clearly and closely draw a division line between the issues of EU citizens and citizens of the so-called "third countries". They provide the reader with necessary processional and legal procedures and subsidiarity of the new Administrative Procedure. In the third chapter, I described the role and functioning of individual administrative authorities in the field of employment, whose main focus is the employment of foreigners. The fourth chapter addresses the employment and legal protection of foreigners as well as granting a work permit to both, the citizens of the European Union, their family members and the foreigners from the so-called "third countries“. The first sub-section deals with the classification of the new Employment Act, where I focused on the fourth part, i.e. the employment of workers abroad. The following sub-section then describes the principles of administrative law and further details the extent of discretionary authority of the administrative authorities in the field of employment as well as the so-called Institute of administrative discretion. The remaining sub-sections analyze the process of obtaining a work permit, which is divided into two larger units, depending on whether the foreign citizens are EU or EEA members, or members of the “third countries’”. What I did was I applied the gained knowledge to a real case taken from practice. Given that the foreigners do not only stay in the Czech Republic in connection with the work and/or employment as employees, the 4.6 sub-section investigates the option “to establish the business enterprise in the Czech Republic by the foreigner”. The fifth chapter tackles the issues and the process of verifying foreign language paperwork and documents, which must be enclosed as a part of the work permit application, the residence permit granting, and further eventual negotiations of the foreigner with the administrative authorities in the Czech Republic. The process consists of three legal regimes: regime of automatic applicability, process of apostile granting , and superlegalisation of appropriate documents. At the same time, I hereto defined the legislative framework concerning the topic. In this context, the different views and perspectives of several authors on their definition of a ‘public document’ are discussed in detail. These individual legal regimes have been applied to some examples of public documents such as the birth certificate, the diploma of formal education, and the certificate of marriage of the foreigners from the so-called “third countries”. The sixth chapter draws attention to the stay of foreigners in the Czech Republic, which is closely linked to granting the work permit issue because it is a necessary second step taken by a foreigner to be able to conduct his/her activities in this state. rs from the so-called "third countries." Again, I chose to utilize the case from practice that I encountered and hereby decided to share the knowledge and experience. I have dealt with the current issue, i.e. upon the client´s entry to the Schengen Area. To compile the thesis, I used the theoretical definition of the issue in various international treaties and legislation, but also drew on my personal experience from the practice completed at the Foreign Police and the Labour Office - Department of Employment of Foreigners in Ostrava. I was also lucky to receive the opportunity to experience the whole process at my own work in person and by doing so I could share my view-point hereto. The fourth, fifth and sixth chapter are enriched by a number of practical procedures, forms used in the practice and attachments. In my opinion, the above described issue is currently in its early development, gradually responding to ever-new ideas emerging from practice and more so, almost every other case seeking the solution is unique. At the same time, the sufficient amount of literature on this issue and the comments to the above named laws are lacking. Also, acquiring the information is quite complicated and time-consuming, which is caused, in my view, by the fact that we now find ourselves at the beginning of the so-called Application practice. Personally, the work on the thesis was a very enriching experience, as the year of intensive work filled with collecting the material and completion of the practice helped me organize my thoughts as well as created a more complex picture of how I would like to proceed in similar future cases.
