Administrative justice in the Czech Republic

Abstract:

Diplomová práce je zaměřena na správním soudnictví v České republice a jeho komparaci se zeměmi EU. V úvodu je uvedena právní úprava správního soudnictví, jak z hlediska českých pramenů práva, tak i mezinárodních. Dále je zde vymezena organizace správního soudnictví, jež obsahuje základní principy správního soudnictví, příslušnost soudů, jejich pravomoc a samotné členění správních soudů. Řízení ve správním soudnictví, jednotlivé druhy žalob a opravné prostředky jsou vymezeny ve třetí kapitole této práce. Poslední částí diplomové práce je komparace českého správního soudnictví se Slovenskou republikou, Německem, Polskem a Francií, kdy se jedná o srovnání jak z hlediska právní úpravy, institucí, tak i řízení, včetně opravných prostředků.

Abstract:

The diploma thesis is focused on administrative justice in the Czech Republic and its comparison with EU countries. The introduction contains the legal regulation of the administrative judiciary, both from the point of view of Czech sources of law and international law. It also defines the organization of the administrative judiciary, which contains the basic principles of the administrative judiciary, the jurisdiction of the courts, their competence and the division of the administrative courts themselves. Proceedings in administrative justice, individual types of actions and remedies are dealt with in the third chapter of this thesis. The last part of the diploma thesis is a comparison of the Czech administrative judiciary with the Slovak Republic, Germany, Poland and France, where it is a comparison both from the point of view of legal regulation, institutions and proceedings, including remedies.
