Judicial Review of the Public Administration Exercised by the Supreme Administrative Court.

Abstract:

této práci se zabývám úlohou Nejvyššího správního soud jako vrcholného soudního orgánu rozhodujícího ve správním soudnictví. Jeho zřízením před více jak čtyřmi lety, došlo k zásadní změně systému správního soudnictví na území České republiky a zároveň k naplnění k naplnění čl. 91 odst. 1 Ústavy České republiky, který do soustavy obecných soudů řadí i Nejvyšší správní soud. Nejdříve jsem se zabýval vývojem správního soudnictví na území České republiky, jeho historií až po současnou úpravu včetně zřízení Nejvyššího správního soudu a vymezení jeho kompetencí. V další kapitole se věnuji jedné ze základních funkcí Nejvyššího správního soudu, a to funkci Nejvyššího správního soudu jako sjednotitele rozhodovací činnosti soudu a jednotlivým nástrojům k tomu soudu svěřeným a pojednávám o institutech stanovisek a zásadních usnesení jako sjednocujících nástrojích směřujících vně Nejvyššího správního soudu, ale i o postupu rozšířeného senátu Nejvyššího správního soudu při odklonu o soudem zastávaného právního názoru jako prostředku zajišťujícím jednotu rozhodování uvnitř Nejvyššího správního soudu samého. V závěru této části se pak zabývám publikaci judikatury ve Sbírce rozhodnutí Nejvyššího správního soudu. S ohledem na skutečnost, že většinu činnosti Nejvyššího správního soudu tvoří právě rozhodování v řízení o kasačních stížnostech, věnuji problematice kasační stížnosti více prostoru, kdy se podrobněji zabývám jednak přípustností a důvody kasační stížnosti

Abstract:

In this thesis I occupy myself with the role of the Supreme Administrative Court as the top judicial body making decisions in the administrative justice. Its establishment over four years ago resulted in a radical change of the administrative justice system in the territory of the Czech Republic and at the same time in the impletion of the Paragraph n. 91 Article n. 1 of the Constitution of the Czech Republic, which ranks the Supreme Administrative Court to the system of the law courts. I first concentrated on the history ofadministrative judiciary in the Czech Republic, its development, and the current system and activity of the Supreme Administrative Court. The newly amended administrative judiciary process is based on Act 150/2002 Coll., governing the Administrative Procedure Code. The fourth section of this diploma thesis discusses the essential function of the Supreme Administrative Court, i.e. the role of the Supreme Administrative Court as a consolidator of the decision - making court procedures, and with the particular instruments entrusted to the Court. This chapter also deals with the institutes of viewpoints and the fundamental resolutions as integrating instruments directed outwards the Supreme Administrative Court. Beside this, it covers the procedures of the extended senate in the Supreme Administrative Court during the deflection by the court legal opinion as the instrument ensuring the decision making unity within the Supreme Administrative Court itself. In the last part in this chapter I occupy myself with the judicature publication in the Compilation of the verdicts at the Supreme Administrative Court. In relation to the fact that most activities of the Supreme Administrative Court are made up by the decision making in the proceedings at cassation appeals, I pay more attention to the problems of the cassation appeals, when I deal in more detail with the admissibility and the reasons for cassation appeals
