The Police as Authority Concerned of Public Administration

Abstract:

Policie České republiky je jednotným ozbrojeným bezpečnostním sborem. Svoji působnost vykonává v rámci území celé České republiky, kdy plní řadu úkolů, jako je ochrana bezpečnosti osob a majetku, ochrana veřejného pořádku, a kromě jiného i prevence a předcházení protiprávní činnosti. Jednou z mnoha oblastí, kde Policie České republiky působí, je tak i dohled na bezpečnost a plynulost silničního provozu. Vzhledem k rozsahu práce není možné detailně se zabývat všemi úkoly, které Policie České republiky v rámci BESIPU vykonává, a proto se dále zaměřuji pouze na vybrané oblasti, v rámci kterých Policie České republiky vydává závazná stanoviska a v souvislosti se zák. č. 13/1997 Sb., o pozemních komunikacích, zákona č. 361/2000 Sb., o provozu na pozemních komunikacích a zák. č. 12/1997 Sb. o bezpečnosti a plynulosti silničního provozu na pozemních komunikacích. Dále také na problematikou vydávávání stanovisek Policie České republiky při posuzování vlivu staveb na bezpečnost a plynulost silničního provozu. Cílem práce je uvést na základě jakých oprávnění je Policie zmocněna vydávat v rámci své působnosti tato stanoviska, v jaké formě, zda jsou tyto stanoviska pro dotčené osoby právně závazná a zda je jejich dodržování vynutitelné.

Abstract:

Police of the Czech Republic is unified armed security force. His powers are executed within the territory of the Czech Republic, which performs a number of tasks, such as protecting the security of persons and property, protection of public order, and among other things, prevention and prevention of unlawful activities. One of the many areas where the Police of the Czech Republic operates the supervision and safety and smoothness of traffic. Given the scope of work is not possible to deal in detail all the tasks that the Police of the Czech Republic within BESIP carries, and therefore I focus only on selected areas within which the Police of the Czech Republic issues binding opinion in connection with the Act. no. 13/1997 Coll., on the road, Act no. 361/2000 Coll., on the road and the Act. no. 12/1997 Coll. safety and flow of traffic on the roads. Furthermore an issue opinions Police of the Czech Republic in evaluating the impact of buildings on the safety and smoothness of traffic. The aim of the thesis is based on what permissions Police is empowered to issue within their scope of these opinions, in what form, whether these opinions to the person legally binding and whether their compliance enforceable.
