Public Defender of Rights and his Activity in the Field of Protection against Discrimination

Abstract:

Předmětem bakalářské práce je přiblížení se problematice diskriminace žen z důvodu pohlaví a uvedení jednotlivých kroků, které provádí Veřejný ochránce práv při ochraně proti ní. Úvodní slova jsou obecně věnována definici pojmu ombudsman, vzniku a vývoji této instituce a jejím typům. Další část je zaměřena na průběh vzniku, ustavování a fungování instituce Veřejného ochránce práv v České republice. Ve třetí části této práce nalezneme informace týkající se diskriminačního jednání. Je zde vysvětlen pojem a jednotlivé druhy diskriminace a také charakteristika toho, jakou roli zaujímá Veřejný ochránce práv v rámci této problematiky. V závěru se věnuji přímo diskriminaci žen z důvodu těhotenství či mateřství. Cílem této práce je analyzovat jednotlivé kroky či úkony ochránce práv, které provádí při jeho šetření. Tato analýza je provedena díky konkrétním případům šetřených ochráncem, na jejímž základě vyvodíme, zda jsou jeho pravomoci dostačující, a tím je efektivní i jeho činnost, či nikoliv.

Abstract:

The subject of this thesis is to approach the issue of discrimination against women for gender reasons and to give an idea of individual measures carried out by the Ombudsman, who protects their rights. The introdutory words are generally devoted to the definition of the term Ombudsman, to the genesis and to the development of this institution and its types. The second part is focused on the progress of the Ombudsman institution formation, establishment and functioning in the Czech Republic. In the third part can be found information regarding discriminatory behavior. It explains the term and different types of discrimination and also characterization of the role occupied by the Ombudsman under the terms of this issue. The closing part is devoted to discrimination against women due to pregnancy or maternity. The aim of this thesis is to analyze the individual steps or acts of the Ombudsman, which he carries out during his investigation. This analysis is done through specific cases investigated by the Ombudsman, on which basis can be deduced whether his jurisdiction is sufficient and thus is also his functioning effective or not.
