The International Criminal Court and the influence of the UN Security Council on its activity

Abstract:

Mezinárodní trestní soud vznikl v roce 2002 jako nezávislá instituce pro trestání nejzávažnějších zločinů mezinárodního práva. Míra nezávislosti, kterou Soud na základě svého statutu disponoval byla však ostře kritizována několika státy, na čele s USA. Ty žádaly podřízení Soudu Radě bezpečnosti OSN, jako orgánu primárně odpovědnému za udržení mezinárodního míru a bezpečnosti. Spojené státy s tímto cílem iniciovaly několik rezolucí v Radě bezpečnosti, dopad kterých tvoří hlavní oblast zájmu této práce. Tyto rezoluce jsou analyzovány z perspektivy realistické a liberální teorie mezinárodních vztahů s cílem poskytnout komplexní obraz ohledně vlivu Rady bezpečnosti na nezávislost Soudu. Pro ucelený pohled na tuto otázku jsou analyzovány také další oblasti vztahu Rady a Soudu, odkázání vyšetřování situace v Dárfúru a vzájemný vztah při stíhání zločinu agrese. Práce předpokládá, že výsledkem činnosti Rady bezpečnosti je značné omezení nezávislosti Soudu z materiálního hlediska.

Abstract:

The International Criminal Court was created in 2002 as an independent institution for punishing the gravest crimes of international law. However, the degree of independence granted to the Court by its statute was sharply criticised by some states, lead by the USA. These states demanded that the Court be subjected to the UN Security Council, the body primarily responsible for the maintenance of international peace and security. The United States initiated several resolutions with this aim in the Security Council, the impact of which is the main field of interest of this thesis. The resolutions are analysed from the perspective of realist and liberal international relations theory with the aim of providing a complex view regarding the influence of the Security Council on the independence of the Court. For a comprehensive view of this question, the other fields of the relationship between the Council and the Court, the referral of the investigations in the case of Darfur and the mutual relationship when investigating the crime of aggression, are analysed as well. The thesis assumes that the result of Security Council activity is a significant limitation of the independence of the Court from a material perspective.
