Abstract:

V této diplomové práci jsem pojednal o problematice kontrolních výborů obcí a krajů. Toto téma je mi blízké, jelikož vykonávám mandát obecního zastupitele a jsem také členem kontrolního výboru. Setkal jsem se tedy s obtížemi, které kontrolní činnost v rámci těchto výborů provázejí. Zajímalo mě, jak strohou právní úpravu v vykládat pro potřeby praxe. Obce a kraje jsou územně samosprávnými územními celky. Jako takovým jim je garantováno Ústavou právo na samosprávu – tedy na možnost samostatně rozhodovat na vlastní odpovědnost ve svém a veřejném zájmu o svých záležitostech a záležitostech svých občanů. Přitom za toto rozhodování nese odpovědnost. Územně samosprávné celky však vykonávají i správu stání v rámci přenesené působnosti. Kontrolní výbory jsou orgánem zastupitelstev obcí, krajů a také hlavního města Prahy. Právní úprava je téměř totožná, proto se v diplomové práci soustředím na obce a u dalších územně samosprávných celků upozorňuji jen na odlišnosti, pokud se nějaké vyskytnou. Kontrolní výbory jsou orgány kontrolní a iniciativní. Jsou vnitřními orgány zastupitelstev a jsou jim odpovědny. Kontrolní orgány jsou povinně zřizovány zastupitelstvem. To je musí zřídit na ustavujícím zasedání zastupitelstva, jinak bez zbytečných odkladů. Zastupitelstvo také volí členy kontrolního výboru. Není zcela jasné, kdo všechno se může na práci v kontrolním výboru podílet. Kromě hlavního města Prahy, je tato problematika neřešená. Domnívám se, že v případě dalších územně samosprávných celků může být členem kontrolního výboru kterýkoliv občan České republiky. Předsedou je vždy člen daného zastupitelstva. Působností – tedy úkoly a činnosti svěřených zákonem – patří kontrola plnění usnesení zastupitelstva a rady obce, dodržování právních předpisů ostatními výbory a obecním úřadem na úseku samostatné působnosti, plnění dalších kontrolních úkolů, jimiž ho pověřilo zastupitelstvo a navrhování opatření směřující k odstranění nedostatků. Pravomocí – prostředky pro výkon působnosti – jsou pak kontrolní oprávnění, jež sice nejsou zákonem konkretizována, avšak lze je vyvodit z povahy cílů, které musí kontrolní výbor dosahovat. Jedná se např. o právo požadovat od orgánů obce informace nutné k provedení kontroly, vyžadovat v rámci svojí působnosti pomoc od orgánů obce, především pak od obecního úřadu, navrhovat zastupitelstvu obce opatření směřující k nápravě a žádat vyjádření orgánu, popřípadě zaměstnanců, jejichž činnosti se kontrola týkala. Kontrolní výbor by se měl scházet podle potřeby. Domnívám se však, že by měl čas od času prověřovat, zda-li není nutné vykonat určitou kontrolu. Právní postavení člena kontrolního výboru nelze zaměňovat s pravomocemi samotného výboru. Člen má však při kontrole od výboru zmocnění a svým prostřednictvím realizuje tak pravomoci výboru. Zabýval jsem se i problematikou aplikace předmětné právní úpravy praxí. Kontrolu výkonu samostatné působnosti provádí Ministerstvo vnitra. Obrací se na něj také občané v záležitostech kontrolních výborů. Ministerstvo však nemůže územně samosprávným celkům nařizovat, jaká opatření mají uskutečnit, pouze doporučuje vhodná řešení. Mezi obvyklé patří dotazy na úkoly a pravomoc kontrolního výboru. Často dochází buď k potlačení kontrolních funkcí kontrolního výboru zastupitelstvem obce, nebo jde o naopak o snahu kontrolního výboru vybudovat si naprosto autonomní postavení či dokonce postavení nadřízené. V rámci práce jsem se zabýval i zahraniční právní úpravou vnitřní kontroly v samosprávě. Vybral jsem si slovenské obecní zřízení. To sice zná obdobu výborů – komise. A

však ty zdaleka nemají takové postavení, jako české kontrolní výbory. Na Slovensku je naopak zřízena funkce hlavního kontrolora, který spojuje působnost českého kontrolního výboru a interních auditorů. Řekl bych, že má dokonce ještě významnější postavení. Nakonec práce jsem doporučil určitá opatření pro aplikaci ustanovení o kontrolních výborech. Především pak doporučuji, aby zastupitelstvo stanovilo statut a kontrolní řád kontrolního výboru. Tam upravilo postavení kontrolního výboru, vztahy s jinými orgány a procesní pravidla pro výkon kontroly.

Abstract:

In my thesis, I have discussed the issue of Commitees Control of Municipal and Regional Councils. This topic is close to me, since serving as a member of the municipal council. I am also a member of the Audit Committee. Because of this, I have encountered difficulties that go along with the control activity of these committees. I wondered how an austere legislation needs to be interpreted in practice. Municipalities and counties are geographically autonomous communities. As such they are guaranteed in the constitution to have the right of self-government - that is, to be able to decide on their own responsibility and on the interest of the public in their affairs and the affairs of its citizens. In doing so, there is the responsibility of their own decision. However, local authorities also perform state administrative under their delegated powers. Authority scrutiny committees are a body of municipalities, counties and the capital city of Prague. The legislation is almost identical, so in this thesis I focus on municipalities and other local governments only to point out the differences, if any occur. The Audit Committee are the body of control and initiative. Councils are the internal organs and they are responsible to them. It is compulsory to establish supervisory bodies by municipal councils. They have to be established at the inaugural session of the particular council without any delay. Councils also elect the members of the Audit Committee. It is not entirely clear who all can participace on the work of audit committees. Besides Prague, this issue remains unresolved. I believe that in the case of other local governments a member of the Audit Committee can be any citizen of the Czech Republic. The chairman is always a member of the council. Applications - that is, tasks and activities assigned by law - control the implementation of council resolutions and the Council of municipalities, compliance committees and other local authorities in the field of autonomous powers, performing other audit tasks which were instructed by the municipal council and the design of measures aimed to eliminate shortcomings. Powers - for the execution of applications – are the ways of control competence, which by law are not specifically explained, but they can be inferred from the nature of goals, which must be reached by the Audit Committee. Examples are the right to require the information necessary to conduct the inspection, requested in the scope of its assistance from the community, especially from the Municipal Office, suggest specific steps and seek activities of authorities and employees, whose activities were checked. The members of the Audit Committee should meet when necessary. In my opinion, I would suggest that the members should meet from time to time to check whether there is any need to do some checking. The legal status of a member of the Audit Committee should not be confused with the powers of the Committee itself. The member executes its mandate through the powers of the committee. I have also dealt with the problems of application of the legislation in question practice. Control of self-governenment is done by the Ministry of Interior. Any citizen on matters of audit committees can address themselves on the Ministry of Interior. The Ministry can not impose territorial self-governing units which measures should be implemented, only recommends appropriate solutions. Typical issues include the functions and powers of the Audit Committee. Often, either to inhibit the control functions of the Municipal Committee, or on the other hand of the Audit Committee to build a completely autonomous or even superior status. As part of the thesis, I have also dealt with the foreign law in the Authority's internal control. I chose the Slovak community establishment. There are analogies between the terms Committees - Commissions. However, their status is far from the function of the Czech system. Slovak Republic, by contrast, established

the position of Chief Controller, which combines the scope of Czech Audit Committee and internal auditors. I believe it has an even more important status. Towards the end of the thesis, I recommend specific measures for the application of the provisions on the control committee. Above all, I recommend that the council should set the status of order and control of the Audit Committee. It should also adjust the position of the Audit Committee, relations with other institutions and procedural rules for the exercise of control.
