Carousel fraud in business transactions

Abstract:

V diplomové práci se zabývám problematikou karuselových podvodů při obchodních transakcích, ať již vnitrostátních, vnitrokomunitárních tak mezinárodních s přihlédnutím k poslednímu vývoji na úrovni České republiky a Evropské unie. Teoreticky zaměřená analytická část popisuje základní principy fungování daně z přidané hodnoty, historii a změny v právní úpravě, které umožnily karuselové podvody ve velkém rozsahu. V rámci komparativních případových studií z poslední dostupné judikatury popisuji nejobvyklejší karuselové či jím obdobné podvody na DPH se vztahem k České republice, jelikož zjištění z provedené analýzy mají dopady na posouzení účinnosti jednotlivých opatření implementovaných za účelem předcházení, identifikování a následně i postihování karuselových podvodů s DPH. Výstupem je popis aktuálních prostředků boje proti karuselovým daňovým podvodům, zhodnocení současného stavu a dalšího vývoje zejména na evropské úrovni.

Abstract:

In my diploma thesis I deal with the issue of carousel fraud in commercial transactions, both domestic, intra - Community and international, taking into account the latest developments at the level of the Czech Republic and the European Union. Theoretically focused analytical part describes the basic principles of operation of value added tax, history and changes in legislation that have enabled carousel fraud on a large scale. In comparative case studies from the latest available Czech case law, I describe the most common carousel or similar VAT fraud in relation to the Czech Republic, as the findings of the analysis have implications for assessing the effectiveness of individual measures implemented to prevent, identify and subsequently prosecute carousel VAT fraud. The output is a description of current means of combating carousel tax fraud, an assessment of the current situation and further developments, especially at the EU level.
