Social and Psychological Specific Features of Questioning Children and Juvenile Persons

Abstract:

Je zřejmé, že výslech dětí a mladistvých především z pohledu sociálně psychologických zvláštností je problémem, kterým by se měly zabývat kvalifikované instituce a orgány. Hledání věcných a přínosných odpovědí, týkajících se tohoto problému, by se mělo stát prioritou zejména pro organizace i jednotlivce, kteří s touto věkovou skupinou obyvatelstva pracují. Vždyť výslech je v psychologické podstatě zvláštním případem sociální interakce {--} komunikace. Hlavním cílem práce bylo popsat zvláštnosti, které se mohou stát příčinou poruchy ve výslechové komunikaci a zcela nebo částečně zablokovat cíl výslechu, tj. dosáhnout pravdivé a smysluplné výpovědi. Snahou bylo zobecnit dostupné poznatky z praxe, což je o to složitější, že každá výslechová situace je specifická a vyžaduje předem promyšlený a řádně připravený postup, závislý na konkrétní situaci. Je nanejvýše žádoucí připomenout, že závěry této práce, která by mohla být dostupná všem zájemcům o problematiku výslechu dětí a mladistvých, mají povahu obecných doporučení, tak jak je potvrzuje praxe.

Abstract:

It is quite obvious that questioning children and juvenile persons poses a problem, in particular from the standpoint of social and psychological specific features, that should be tackled by competent institutions and bodies. Searching for relevant and meaningful answers relating to this problem should become the top priority for organizations and individuals dealing with the mentioned age group, given that from the psychological point of view it is a case of social interaction {--} communication. The main objective of the present dissertation was the description of specific features which may hinder the communication in the process of questioning and so block, in whole or in part, the purpose of the questioning, that is, to elicit true and meaningful answers. The author tried to generalize the knowledge available from experience, a rather difficult task, as each questioning has its specifics and calls for a well-thought-out and thoroughly prepared process depending on a particular situation. It must be stressed that the conclusions presented in this dissertation, which could be made available to all those interested in the problems of questioning children and juvenile persons, are to be taken as general recommendations that have been proved in practice.
