Analysis of the EU-Turkey agreement

Abstract:

Tato bakalářská práce je jedinečnou případovou studií, která se věnuje migrační dohodě uzavřené mezi EU a Tureckem v roce 2016. Stanoveným cílem práce je pomocí analýzy implementace dohody a vyhodnocení naplnění zájmů zainteresovaný stran zjistit, zdali může být dohoda považovaná za win-win-win partnerství, tedy za partnerství, které je prospěšné pro všechny aktéry - EU, Turecko i migranty. Migrační dohoda je příkladem externalizace migrační politiky EU, v rámci které je často vyzdvihovaná jako model k následování pro uzavírání spolupráce s třetími zeměmi. Dohoda však obsahuje četné problémy ohledně legality, autorství i samotného plnění. Často je také dohoda kritizována lidskoprávními organizacemi za porušování lidských práv. Uzavření migrační dohody s Tureckem je reakcí na migrační krizi vrcholící v roce 2015. Dohoda měla za cíl zamezit toku nelegální migrace přes Turecko do Evropy, rozbít obchodní model pašeráckých gangů a umožnit migrantům alternativu k riskování jejich života otevřením bezpečných a legálních cest do Evropy.

Abstract:

This bachelor thesis is a unique case study that examines the EU-Turkey Agreement on migration concluded in 2016. The stated aim of the thesis is to determine whether the Agreement can be considered a win-win-win partnership, i.e. a partnership that benefits all stakeholders - EU, Turkey and migrants. To achieve this aim, the work analyzes the implementation of the Agreement and evaluates the fulfillment of the interests of stakeholders. The Agreement is an example of the externalization of the EU migration policy, which is often highlighted as a model to follow for cooperation with third countries. However, the Agreement contains numerous problems regarding legal nature, authorship and its implementation. The Agreement is also often criticized by human rights organizations for human rights violations. The conclusion of the Agreement with Turkey is a response to the migration crisis culminating in 2015. Its aim is to prevent the flow of illegal migration through Turkey to Europe, to break the business model of the smugglers and to offer migrants an alternative to putting their lives at risk by opening safe and legal routes to Europe.
