Taxation of Conventional and Alternative Taxis

Abstract:

Diplomová práce na téma Zdanění klasické a alternativní taxislužby se zabývá problematikou regulatorního rámce a daňové právní úpravy spojené s poskytováním osobní přepravy v rámci tzv. sdílené ekonomiky. Úvodní část práce je věnována definování pojmu sdílená ekonomika a popisu jednotlivých subjektů participujících na realizaci alternativních způsobů osobní přepravy. Druhá část práce se zaměřuje na vymezení činnosti těchto subjektů v kontextu unijního práva a aplikace české veřejnoprávní regulace. Hlavní část práce je následně věnována otázkám aplikace daňového práva a specifik vyplývajících z jedinečné povahy poskytování služeb sdílené ekonomiky, prostřednictvím digitální aplikace a vzájemného vztahu mezi uživateli těchto aplikací. Autor práce dochází k závěru, že je možné aplikovat současnou právní úpravu v mantinelech hodnotících kritérií povahy činnosti subjektů alternativní taxislužby, které komparuje s taxislužbou tradiční. Předkládá také argumenty, proč považovat činnost řidičů alternativní taxislužby za soustavnou a samostatnou ve vztahu k veřejnoprávní regulaci a daňovým povinnostem z této činnosti plynoucí. Práci uzavírá přehled vybraných problémů sdílené ekonomiky se zaměřením na regulaci a da-ně, spolu s návrhy jejich řešení.

Abstract:

The diploma thesis on the topic Taxation of classic and alternative taxi services deals with the issue of the regulatory framework and tax legislation associated with the provision of personal transport within a shared economy. The introductory part of the work is devoted to defining the concept of shared economy and a description of individual entities participating in the implementation of alternative modes of personal transport. The second part of the thesis focuses on defining the activities of these entities in the context of EU law and application of Czech public law. The main part of the work is then devoted to issues of application of tax law and specifics resulting from the unique nature of providing services of a shared economy through a digital application and the relationship between users of these applications. The author of the thesis concludes that it is possible to apply the current legislation in the terms of evaluating the criteria of the nature of the activities of the subjects of alternative taxi service, which then compares with the traditional taxi service. Author also presents arguments why to consider the activity of drivers of alternative taxi services as systematic and independent in relation to public law regulation and tax obligations arising from this activity. The work concludes with an overview of selected problems of the shared economy with a focus on regulation and taxes, along with proposals for their solution.
