Abstract:

Tématem této diplomové práce je směrnice Evropského parlamentu a Rady 2009/138/ES, o přístupu k pojišťovací a zajišťovací činnosti a jejím výkonu („Solvency II“), která upravuje pravidla solventnosti pro pojišťovny na území Evropské unie, a její dopad na pojistný trh v České republice, se zaměřením na Allianz pojišťovnu a.s. Úvodní část práce obsahuje teoretická východiska pojišťovnictví – definici základních pojmů a historický vývoj pojišťovnictví na území Evropské unie. Dále je zde přiblížen proces implementace směrnice do českého právního řádu. Praktická část je poté zaměřena na implementaci směrnice v prostředí Allianz pojišťovny a.s., a na důsledky které pro pojišťovnu vznikly účinností Solvency II. Závěr práce je věnovaný úvaze o budoucnosti směrnice.

Abstract:

The topic of this diploma thesis is the directive 2009/138/EC of the European Parliament and of the Council of 25 November 2009 on the taking-up and pursuit of the business of Insurance and Reinsurance („Solvency II “), which regulates the rules of solvency for insurance companies within the European union area and its impact on the insurance market in the Czech Republic, with focus on the insurance company Allianz pojišťovna a.s. The opening part contains the theoretical resource of insurance - the definitions of basic terms and the historical development of insurance within the European union area. The process of implementation of the abovementioned directive into the Czech legal system is included in the next part of this thesis. The practical part of the thesis is focused on the implementation process of the directive in the environment of the insurance company Allianz pojišťovna a.s. and on the consequences connected with the effect of Solvency II. The final part contains considerations for the future about the abovementioned directive.
