Criminal proceedings in juvenile cases

Abstract:

Zákon č. 218/2003 Sb., o soudnictví ve věcech mládeže je účinný od 1. 1. 2004 a vztahuje se na protiprávní činy, kterých se dopustily osoby mladší osmnácti let. Cílem projednávání protiprávních činů mladistvých a užití opatření podle zákona o soudnictví ve věcech mládeže je snaha odradit mládež od páchání takových činů, poskytnout pomoc mladistvému při hledání společenského uplatnění a odčinění vzniklé újmy a zároveň předcházet a zamezovat páchání těchto činů. Diplomová práce s názvem Řízení ve věcech mladistvých se věnuje tomuto řízení z pohledu trestního práva a je zaměřena na právní stav od 1. 10. 2010, tedy od doby, kdy je účinný nejen zákon č. 218/2003 Sb., ale i zákon č. 40/2009 Sb., a jejich užívání na území České republiky. V práci je objasněn smysl právní úpravy, základní pojmy, se kterým zákon pracuje, vysvětleny základní zásady, specifika jednotlivých fází řízení a v neposlední řadě je v ní stručně shrnuto řízení ve věcech trestně neodpovědných dětí. Stěžejní část práce tvoří kapitola 6, která se věnuje analýze dvou trestních spisů. V práci je zhodnocena právní úprava trestního řízení mladistvých jak de lege lata, tak de lege ferenda. V závěru práce jsou navrhnuty drobné změny právní úpravy, které by mohly být přínosné pro trestní řízení ve věcech mladistvých.

Abstract:

Act. No. 218/2003 Coll., on Liability of Juveniles for Illegal Acts and on Juvenile Justice and Amending Certain Acts (The Act on Juvenile Justice) came to force on 1 January 2004. It is dedicated to unlawful acts committed by perpetrators under 18. The aim of Act on Juvenile Justice is to create appropriate conditions for the correction of delinquent juveniles. Its purpose is not to punish the youth primarily, but to change their behavior and prevent them from committing repeated offences. The Act aims to ensure that youth delinquents refrain from committing other illegal acts, and find their place in the society, corresponding with their abilities. The diploma thesis titled Proceedings in Juvenile Cases is dedicated to the proceedings from the perspective of criminal law and deals with legislation from 1 October 2010 since the Act No. 218/2003 Coll. and Act No. 40/2009 Coll. were effective and their use in the Czech Republic. In this thesis there are explained meaning of legislation, basic principles, basic concepts with which Act works, specifics of proceeding, and proceeding in cases of children under 15 which are criminally irresponsible. Main part of the thesis is chapter 6 where two criminal files are analyzed. In this thesis current legislation (de lege lata) is evaluated and it also suggestions de lege ferenda are mentioned. In the end there are suggested minor changes of legislation which could be beneficial for criminal proceedings in juvenile cases.
