Securing and corroboration of debts resulting from mortgage loans

Abstract:

Diplomová práce zpracovává problematiku zajištění a utvrzení hypotečních úvěrů, tedy úvěrů, které jsou alespoň částečně zajištěny zástavním právem k nemovité věci. Hypoteční úvěr tvoří zpravidla dvě smlouvy, a to smlouva úvěru, kterou vzniká závazkový právní vztah věřitele a dlužníka, a k ní zajišťovací instrument představující zástavní právo zřízené zástavní smlouvou, kde je specifikována nemovitost spolu s právy a povinnostmi, která zajišťuje úvěr. Diplomová práce je vyhotovena popisnou a komparativní metodou. Podrobně zpracovává zajišťovací a utvrzovací instrumenty občanského práva, které se přímo týkají hypotečních úvěrů, které byly a nadále jsou uzavírány se spotřebiteli, a to v rámci spotřebitelského úvěru na bydlení. Detailně též rozpracovává utvrzovací instrumenty vyplývající z NOZ, tedy smluvní pokutu a uznání dluhu, a to včetně uznání dluhu v rámci notářského zápisu s přímou vykonatelností. Závěrečná kapitola je věnována komparaci jednotlivých hypotečních smluv od vybraných poskytovatelů.

Abstract:

This thesis processes the issue regarding mortgage credit secured by their pledges. The mortgages are loans which are at least partially secured by their pledges based on property lien. Mortgage consist of the contract regarding the base loan and the contract regarding the pledge, in which is the property described including the rights and duties. In this thesis the author uses methods of description and comparation to cover the instruments regarding the securement and corroboration of debts. Including property lien, guarantees, contractual penalty and acknowledgement of debt included in The Civil Code, also with the inclusion of notarial deeds based on The Notaries Code. I will also include the issues regarding the consumer protection based on Consumer Credit Acts of 2010 and 2016. Lastly the author will compare mortgages offered by the financial institutions regarding the rights and duties included in their contents.
