Expiration of Rights in Tax Proceedings

Abstract:

Tato rigorózní práce se zabývá problematikou prekluze v daňovém řízení. Kromě definice a porovnání prekluze (a promlčení) v daňovém řízení s prekluzí v ostatních právních oblastech je v této práci rozebrán vývoj úpravy prekluze a promlčení v daňových předpisech České republiky. Dále jsou v této práci charakterizovány i zahraniční právní úpravy ohledně lhůty pro stanovení daně v jednotlivých členských státech Evropské unie. V práci je rovněž zmíněna novela § 47 zákona o správě daní a poplatků účinná od 1.1.2010 a úprava prekluze v daňové řádu účinném od 1.1.2011. Cílem této práce je po důkladné analýze právních předpisů i soudních rozhodnutí stanovit, zda-li je současná (a budoucí) úprava prekluze v daňovém řízení vhodná a pokud ne, pokusit se navrhnout vlastní formulaci úpravy prekluze v daňovém řízení.

Abstract:

This rigorous thesis concerns with the expiration of rights in tax proceedings (in Czech "prekluze"). In addition to the definition of "prekluze" (and statute-barred claim, in Czech "promlčení")and comparation of it with "prekluze" in other legal areas, this thesis contains also the history of development of legislation regarding "prekluze" and "promlčení" in tax laws of the Czech Republic. Next, there are included also the time limits for tax assessment and additional tax assessment in all Member States of the European Union. There is also mentioned an amendment to Article 47 of Administration of Taxes Act with effect as of 1 January 2010 and definition of time limit for tax assessment in new Tax Code, which should take effect as of 1 January 2011. The aim of this thesis is, based on through analysis of laws and judicial decisions, to review whether the current (and future) legislation regarding the expiration of rights in tax proceedings is suitable or not and if not, try to suggest own wording of definition of "prekluze" in tax proceedings.
