Right to Legal Judge

Abstract:

Diplomová práce se zabývá otázkou práva na zákonného soudce jako ústavněprávního principu. Autorka se nejprve věnuje obecnému vymezení pojmu, historickému kontextu a poté vymezuje základní součásti tohoto práva jako je příslušnost soudů, rozvrhy práce či podjatost soudců. Dále autorka rozebírá relevantní judikaturu především Ústavního soudu České republiky a Evropského soudu pro lidská práva. Závěrem práce autorka formuluje zobecnitelná pravidla, jejichž dodržování by mělo být receptem k dodržování práva na zákonného soudce a hodnotí stávající právní úpravu.

Abstract:

This diploma thesis addresses the topic of the right to a legal judge as a constitutional principle. Firstly, the author provides a general definition of this concept, followed by the historical context, and then describes the basic components of this right as the jurisdiction of the courts, work schedule or partiality of judges. The author then discusses the relevant case law; particularly that from the Constitutional Court of the Czech Republic and the European Court of Human Rights. Finally, the author formulates generally applicable rules that could be a recipe for not violating the right of the legal judge and tries to evaluate existing legislation.
