Civil Relationship according the Act on Civil Service

Abstract:

Diplomová práce se zaměřuje na některé dílčí aspekty zákona č. 234/2014 Sb., o státní službě, v platném znění, kterými jsou působnost zákona, jeho podstata, státní služba, její organizace a systemizace a zejména služební poměr. Práce ve svých kapitolách zachycuje teoretická východiska veřejné správy, vývoj legislativy státní služby a systémy a principy státní služby. Těžištěm je však služební poměr státních zaměstnanců, a proto je mu věnována podstatná část této práce. Zahrnuje jednotlivé fáze služebního poměru, a to od vzniku až po jeho skončení. Cílem je posoudit, zda se podařilo naplnit principy zákona o státní službě v souvislosti se služebním poměrem, poukázat na případná problematická ustanovení této právní úpravy a navrhnout vlastní doporučení, které by tyto nedostatky pomohlo odstranit.

Abstract:

The thesis focuses on certain aspects of the law on civil servants (n. 234/2014) as currently applicable, as the scope of this act, its nature, state service as such, its organization and systemization, and mainly the employment relationship of public servants. Theoretical basis of public administration, evolution of state service legislation including state service systems and principles are concerned in the specific chapters of the thesis. The core of the thesis is the employment relationship of public servants and therefore significant attention is devoted to this topic. The thesis topic includes different stages of the employment relationship of public servants, since the establishment of the employment relationship until its termination. The aim is to consider whether the principles of the act was matched and reflected in the employment relationship of public servants adequately, point out problematic provisions of the act and propose own recommendation how to eliminate the deficiencies.
