The comparison of national and EU regulation of the position of the consumer in selected institutes of consumer law

Abstract:

Tato práce se zabývá porovnáním ochrany spotřebitele z hlediska současné unijní a vnitrostátní úpravy. Ke dni 6. ledna 2023 vstoupila v ČR v platnost rozsáhlá novela, která přináší změny do úpravy ochrany spotřebitele. Jedná se o transpozici unijních směrnic do vnitrostátní právní úpravy. Ochrana spotřebitele je velmi obsáhlá a věnuje se mnoha oblastem spotřebitelských vztahů. Cílem této práce je porovnání stávající unijní a vnitrostátní úpravy na příkladu vybraných institutů a zjištění, zda jsou obě úpravy v souladu, či zda některá z úprav zajišťuje spotřebiteli vyšší ochranu. Předmětem této práce bude porovnat změny mimo jiné v oblasti e-commerce, slevových akcí, reklamací a recenzí zákazníků. V těchto oblastech došlo v rámci zmiňované novely k výrazným změnám, které by měly spotřebiteli přinést další ochranu.

Abstract:

This thesis compares consumer protection from the point of view of current EU and national regulations. On January 6, 2023, an extensive amendment came into force in the Czech Republic. It brings changes to the consumer protection regulation. This is the transposition of EU directives into national legislation. Consumer protection is very extensive and deals with many areas of consumer relations. The aim of this work is to compare the current EU and national regulations on the example of selected institutes and to find out whether the two regulations are consistent or if one of the regulations provides higher protection to the consumer. The subject of this thesis will be to compare changes in the field of e-commerce, discount events, complaints and customer reviews, among others. In these areas, significant changes have taken place within the aforementioned amendment, which should bring additional protection to the consumer.
