The right to health and medical care in the jurisprudence of the Constitutional court of the Czech Republic

Abstract:

Tématem předkládané diplomové práce je právo na zdraví a na lékařskou péči se zaměřením na problematiku povinného očkování. Práce si klade za cíl komplexně představit uvedenou tématiku. Za tímto účelem dochází k rozboru právní úpravy jednotlivých dílčích práv týkajících se práva na zdraví a lékařské péče ve vnitrostátních i mezinárodních instrumentech, tak pramenů vztahující se k otázce povinného očkování. V práci nalezneme aktuální stav očkování na našem území a ve vybraných státech EU. Zároveň jsou v práci na základě judikatury Ústavního soudu popsány přístupy Ústavního soudu k právní úpravě povinného očkování a aktuálním otázkám povinného očkování.

Abstract:

The theme of this presented thesis is the Right to Health and Medical Care according to the jurisprudence of the Constitutional Court with a focus on the issue of compulsory vaccination. The aim of this work is to fully introduce the listed topics. For this purpose, the legislation on the individual rights relating to the right to health and medical care in national and international instruments relating to compulsory vaccination and the question to vaccination itself are analysed. In this dissertation we can find current status of vaccination on our territory and selected countries of EU. There are described approaches based on the jurisprudence of the Constitutional Court to the question of Constitutional Court's legislation to mandatory vaccination and to current questions about mandatory vaccination.
