Hugo Chávez's Constitutional Reforms Analysis

Abstract:

Tématem diplomové práce jsou ústavní reformy nynějšího venezuelského prezidenta Hugo Cháveze, resp. analýza tohoto reformního úsilí ve vztahu k budování "socialismu 21. století". Chávez v roce 1999 vytvořil novou ústavu, jež přináší pro venezuelskou politiku zásadní změny. V prezidentských volbách 2006 pak Chávez potvrdil svůj úřad, následně zrušil Hnutí páté republiky a založil PSUV (Partido Socialista Unido de Venezuela), což by mělo zvyšovat možnost jeho mocenské kontroly. Chávez se dále rozhodl pokračovat v ústavně - reformním procesu, jenž by měl směřovat k naplnění jeho ideálu, tyto snahy o reformu ústavy však nebyly v referendu koncem roku 2007 schváleny.Cílem práce je srovnat ústavu z roku 1999 s reformním návrhem z roku 2007 a podrobně analyzovat návrh Chávezovy ústavní reformy z pohledu demokratických principů. Tato práce bude vycházet z premisy, že Chávezovo redukování demokracie v zemi ohrožuje fungování demokracie a směřuje k nastavení socialistického modelu, který vykazuje autoritářské tendence.Jako metoda této práce bude použita případová studie a obsahová analýza vybraných dokumentů

Abstract:

This thesis focus on the present-day Venezuela President’s constitutional reforms, respectively analysis of reformatory effort in relation to the construction of ‚socialism in 21st century‘. In 1999 Hugo Chávez drafted a new constitution, which can bring some radical changes to politics in Venezuela. He was re-elected in president’s election which took place in 2006. Later on he dissolved the Fifth Republic Movement (a socialist party in Venezuela). It was a step which could make his power politics stronger. Chávez decided to continue in the process of constitutional reforms further, which had to lead to the fulfilment of his dreams. Nevertheless, these efforts to change the constitution were not approved by voters in a national referendum at the end of 2007.The objective of the the thesis is to compare the constitution which was adopted in 1999 with a draft constitution presented in 2007. Another objective is to analyse in detail Hugo Chavez’s draft constitution in terms of democratic principles. The thesis is based on the assumption that the suppression of democracy by Chávez threatens the democracy itself and leads to the establishment of a socialist model which demonstrates authoritarian tendencies.A case study and content analysis of selected documents will be used as methods in the paper.
