Presidential Powers

Abstract:

Tato diplomová práce se zabývá postavením prezidenta republiky jako hlavy státu s ohledem na ústavní systém, jehož je prezident jako ústavní orgán součástí. V nejobsáhlejší kapitole této práce jsou rozebrány jednotlivé prezidentské pravomoci, přičemž důraz je kladen na jejich dělení z hlediska nutnosti kontrasignace. Zároveň je zde poukázáno na nejčastěji diskutovaná problematická témata týkající se výkonu některých pravomocí a názory pro jejich řešení. Poslední kapitola se věnuje klíčovým otázkám, jejichž zodpovězení je cílem této práce, a sice zdali prezident může odmítnout jmenovat řádně navrženou osobu do funkce a zdali je takové rozhodnutí soudně přezkoumatelné.

Abstract:

The diploma thesis is focused on status of the President as a head of the state with regard to the constitutional system in which the President takes a part as a constitutional body. The largest chapter deals with each presidential power separately and it puts stress on the fact wheather performance of the power needs to be countersigned. It also pursues to highlight crucial issues related to the presidential powers and to find suitable solutions. Finally, the main part follows the questions wheather the president is allowed to refuse to perform an appointment on proposal and wheather such refusal is admissible to be reviewed within judicial power.
