Abstract:

Diplomová práce je zaměřená na časté téma podnikatelské sféry – úpadek, insolvenci, konkurs a likvidaci společnosti. Insolvenční zákon přinesl s účinností od 1.1.2008 podstatné změny v oblasti úpadkového práva, které jsou objasněny v první polovině diplomové práce. Druhá část diplomové práce se zabývá analýzou situace insolvencí v měsíci prosinci 2012 a následně popisuje novelu insolvenčního zákona vůči insolvenční šikaně platný od 1.11.2012, kde je názorně rozebrána společnost, která jako první po novele dosáhla finančního odškodnění za insolvenční šikanu.

Abstract:

Diploma thesis if focused on frequent topic of business – bankruptcy, insolvency and liquidation. Insolvency Act with effect from 1.1.2008 brought substantial changes in the bankruptcy law, which is explained in the first half of the thesis. The second part of the thesis deals with the analysis of the situation of insolvency in December 2012, and describes an amendment to the insolvency Act about insolvency bullying valid from 1.11.2012, where is clearly listed company, which was the first after the amendment that achieved financial compensation for insolvency bullying
