Labour-Law Relations after Recodification of Private Law in the Czech Republic

Abstract:

Tato bakalářská práce se zabývá právní úpravou pracovněprávních vztahů v České republice. Hlavním cílem práce je rozbor platné právní úpravy základních individuálních pracovněprávních vztahů v České republice v souvislosti s rekodifikací soukromého práva. Rozbor právní úpravy je převážně zaměřen na vztah zákoníku práce a nového občanského zákoníku a na vznik, změnu a skončení těchto pracovněprávních vztahů. Mimo jiné práce obsahuje i průřez historického vývoje právní úpravy pracovněprávních vztahů a koncepci právní úpravy v rámci mezinárodního pracovního práva a práva Evropské unie. Součástí bakalářské práce je dotazníkové šetření, jehož hlavním cílem je vyhodnotit informovanost širší veřejnosti z oblasti pracovního práva. Některé jednotlivé části práce jsou doplněny o praktické příklady a významnou judikaturu.

Abstract:

This thesis deals with the regulation of labour-law relations in the Czech Republic. The main objective of the thesis is to analyze the current legislation of individual labour-law relations in the Czech Republic in connection with the recodification of private law. The analysis of the legislation is mainly focused on the relationship between the Labour Code and the new Civil Code and further on the establishment, modifications and termination of the labour-law relations. Among others, the thesis also includes a summary of the historical development of the legislation of labour-law relations and the concept of the legislation within the international labour law and the law of the European Union. A survey, the main objective of which is to evaluate the awareness of the general public in the field of labour law makes part of the thesis. Some sub-sections are supplemented by practical examples and important judicature.
