Legis Speak and Creative Translation Solutions in EU Texts: Strictly Legislative Versus Related Texts

Abstract:

Cílem předkládané práce je charakteristika rozdílných strategií při překladu textů Evropské unie a také popis dvou základních druhů těchto dokumentů. Jednak legislativních textů, jež obsahují především právní formulace a jejich překlad je omezen manuály zajišťujícími jednotnost, a jednak textů příbuzných Evropské legislativě, které spadají do nové kategorie administrativních dokumentů sloužících ke komunikaci mezi Evropskou unií a širokou veřejností. V mnohých ohledech speciální překlad pro Evropské instituce je v diplomové práci propojen s překladovými univerzáliemi, které slouží k analyzování míry nesrozumitelnosti, nebo naopak tvořivých řešení v daném korpusu. Překladové univerzálie jsou univerzální jevy v procesu překladu, díky kterým jsou výsledné texty buď čtivější, nebo které naopak znesnadňují jejich pochopení a komplikují větnou strukturu. Kromě obecného popisu se v práci nachází i množství rozličných příkladů každé univerzálie. Diplomová práce dokazuje, že hlavním kriteriem při vědomém i nevědomém používání univerzálních překladových jevů je druh cílového čtenářstva, který se u obou typů EU textů výrazně liší.

Abstract:

The principal aim of the thesis is to characterize different translation strategies in the EU environment and describe two prevailing kinds of the EU texts – strictly legislative ones, which include mainly legal formulas and are bounded by translation manuals issued to secure their uniformity, and related texts, a new category of administrative texts used for the communication between the EU and the wide public. The specific field of translation for the EU institutions is interconnected with translation universals, which served as a basic means of analyzing the level of obscurity or creativity in a corpus of the EU texts. Translation universals are universal tendencies in translation process, whose presence either makes the texts more reader-friendly or makes their sentence structure more complex or complicated. Every universal is defined, commented on and different ways of manifesting it are described with relevant examples. The distinction between the readerships of the two textual categories proved to be the major limitation determining which universal dominates in which part of the corpus.
