Criminalistic and Criminal Aspects of Fire Investigation

Abstract:

Diplomová práce je zaměřena na zjišťování příčin vzniku požárů, jakožto jednu z forem výkonu státního požárního dozoru, která je zákonem svěřena Hasičskému záchrannému sboru České republiky. Ačkoli tuto formu státního požárního dozoru vykonávají vyšetřovatelé požárů hasičského záchranného sboru, dochází při ní k úzké spolupráci s příslušníky Policie České republiky, a to jak v rovině kriminalistické, tak v rovině trestněprávní. Primárním cílem práce je přiblížit zjišťování příčin vzniku požárů na území České republiky, a to v součinnosti příslušníků obou jmenovaných bezpečnostních sborů. Značná část práce je proto věnována ohledání požářiště, kde celý proces zjišťování příčiny vzniku požárů začíná, včetně vymezení specializovaných pracovišť, která se na ohledání a dalším vyšetřování příčiny požáru mohou podílet, typicky prostřednictvím kriminalistické expertizy. Dalším zásadním cílem práce je vymezit, jakého deliktního jednání se mohou právnické a fyzické osoby v souvislosti s požáry dopustit, a to jak v rovině správního, tak soudního trestání. Z tohoto důvodu budou předně objasněny možné příčiny vzniku požárů, se zaměřením na úmyslné založení požáru a přehled možných motivů jeho pachatele. Praktická část práce je věnována jednak kazuistice vybraného trestného činu obecného ohrožení z nedbalosti, jež bylo způsobeno iniciací požáru, a dále vyhodnocení anonymního dotazníku, kterého se zúčastnilo 213 respondentů z řad policistů. Dotazník byl zaměřen na základní znalosti policistů z oblasti vyšetřování požárů, přičemž cílem bylo zmapování vědomostí dotázaných a zhodnocení aktuálního stavu součinnosti při vyšetřování požárů mezi příslušníky Hasičského záchranného sboru České republiky a Policie České republiky.

Abstract:

The thesis aims at identifying the causes of fires, as one of the forms of performance of state fire surveillance entrusted by law to the Czech Republic Fire Rescue Service. Although this form of state fire surveillance is carried out by fire investigators of the fire brigade, it involves close cooperation with members of the Police of the Czech Republic, as in criminalistics level, so in level of criminal law. The primary goal of the work is approximate the detection of the causes of fires on the territory of the Czech Republic, in cooperation with members of the mentioned defence units. A significant part of the work is devoted to examining the scene of a fire. There the whole process of determining the cause of the fires begins. It includes defining the specialized workplaces that can participate in the examination and further investigation of the cause of the fire, typically through criminology expertise. Another fundamental objective of the thesis is to define what offender conduct legal and natural persons may commit concerning fires, both in terms of administrative and judicial punishment. For this reason, the possible causes of the fires will be above all clarified. Attention goes to deliberately starting the fire and an overview of the possible motives of its perpetrator. The practical part of the work is devoted to the case study of the selected criminal offence of general endangerment as a consequent of negligence caused by the start of the fire. Further, the evaluation of an anonymous questionnaire in which involved 213 police respondents. The survey focused on the basic knowledge of police officers in the field of fire investigation. The aim was to map the general understanding of the topic by respondents and evaluation of the current state of cooperation within fire investigation among members of Fire Rescue Service of the Czech Republic and Police of the Czech Republic.
