The enforceability of taxes and charges in cooperation with law enforcement authorities

Abstract:

Tato práce se zabývá zkoumáním vývoje rychlosti, efektivity a účinnosti procesu vymáhání daní a poplatků. Požadované ukazatele jsem hodnotil od 1.1.1998, kdy se stala účinnou nová skutková podstata trestného činu a to neodvedení daně, pojistného na sociální zabezpečení, na zdravotní pojištění a příspěvku na státní politiku zaměstnanosti (§ 147 trestního zákona). Z provedeného rozboru vyplývá, že sledované ukazatele, a to zejména počet sledovaných trestných činů (§§ 147 a 148 tr. zákona), délka jejich objasnění, výše způsobené škody apod. nelze jednoduše zobecňovat, protože jsou poplatné jednotlivým sledovaným regionům, které se od sebe liší rozlohou, počtem obyvatel a také hospodářskou rozvinutostí, polohou a zaměstnaností , což má výrazný vliv na počet všech trestných činů v dané oblasti i na skladbu trestných činů. Rovněž nelze opomenout i význam vstupu České republiky do Evropské unie dne 1.5.2004, s tím související přijaté nové právní předpisy a následné změny ve struktuře Policie České republiky.

Abstract:

This extended essay deals with indicators from the point of view and the time development of speed, efficiency and operability of taxes and contributions. The coefficients of levying were evalueted since 01.01.1998, when the new body of the crime has come in force, namely the offence of not paying the taxes, the social insurance and medical insurance contributions as well as the state employment policy contributions (art. 147 of the Criminal Law). The assessment has indicated that the it is not possible to simply generalize indicators being analyzed, namely number of observed criminal offenses (art. 147 and 148 of the Criminal Law), time of their detection, harm done etc. so as they depend on the regions which differ from the point of view of the area, population as well as the degree of their economic development and locality. The above mentioned factors are of the crucial importance when having a look at the number of criminal offences committed in the particular region and their structure. There is another important factor that must not be omitted: the Czech Republic joining the European union (1.5.2004) and the new legislative regulations as well as further changes of the structure of the Police of the Czech Republic.
