Public preservation of historical monuments in the Czech republic in position of prejudiced authority

Abstract:

Státní památková péče v ČR v postavení dotčeného orgánu. Zadané téma diplomové práce se týká výkonu státní památkové péče v České republice. Těžiště práce se má zabývat dvěma vybranými okruhy památkové péče, a to péčí o nemovité kulturní památky a archeologickou památkovou péčí, při jejichž výkonu se mohou orgány státní památkové péče stát dotčeným orgánem, a to zejména v podmínkách uplatňování nových zákonů č.500/2004 Sb., správního řádu, a č.183/2006 Sb., stavebního zákona. S ohledem na polistopadové pokusy o novou zákonnou úpravu by práce měla srovnat situaci v ČR s výkonem památkové ochrany ve vybraných zemích Evropské unie, z historických důvodů stejného zákonného základu byly zvoleny nástupnické státy rakousko – uherské monarchie. Jako zvlášť významné se jeví srovnání se státní památkovou péčí Slovenské republiky. Závěrem by bylo účelné nastínit možná východiska nové zákonné úpravy.

Abstract:

The public preservation of monuments in Czech republic regarding the concerning executive body. The issue of this thesis is the execution of the public preservation of monuments in Czech republic. The main theme of these thesis should work with two selected subjects of the preservation of monuments, and this means preservation regarding the cultural immovable monuments and archeological monument preservation, whereby the the bodies of the public preservation of monuments could become the concerning body in the situation of execution of the new laws No. 500/2004 - Administrative codex, and No. 183/2006 Building law. Having regard for the „after-November“ attempts and regarding the new monuments preservation law , should the thesis also compare the execution of the preservation of monuments in choosen countries of the European union with the same historical background. The successor counties of the Austrian-Hungary Empire were choosen for this example. A main important part of these comparison seems to be the comparison with the public preservation of monuments in the Slovak republic. The conclusion should be the the looking for a new way for a new law text.
