Relation between methodological recommendations and the Public Procurement Act when awarding contracts within ESI Funds projects

Abstract:

Oblast zadávání veřejných zakázek financovaných z Evropských strukturálních a investičních fondů je protkána mnoha materiálními i formálními prameny práva, která zadavatel musí dodržovat. Nejednoznačná hierarchie právní závaznosti těchto norem má pro zadavatele zakázek nežádoucí důsledky. Cílem diplomové práce je podat vysvětlení provázanosti vztahů právní úpravy těchto zakázek, v čem spočívají problémy spojené s těmito nejasnostmi a na tomto základě podat návrhy možných řešení dané problematiky. Teoretická část práce objasňuje základní pojmy, jako je např. zadavatel veřejné zakázky nebo koncept veřejné podpory v rámci EU. V této části jsou dále uvedeny formální a materiální prameny práva související se zkoumaným tématem a je vysvětlena provázanost vnitrostátní právní úpravy. Praktická část se věnuje dopadům nejednoznačnosti vztahů právní úpravy zadávání zakázek v ČR, tj. možnými sankcemi, v případě některého z pochybení učiněného zadavatelem zakázky, kdy jsou tyto skutečnosti demonstrovány na skutečných případech. V závěru práce jsou nastíněna potenciální východiska pro vyvarování se negativních důsledků z chybně zpracované a následně realizované veřejné zakázky, která byla podpořena z fondů EU.

Abstract:

The area of public procurement funded by the European Structural and Investment Funds is interwoven with many material and formal sources of law that the contracting authority must follow. The ambiguous hierarchy of legally binding standards has adverse consequences for contracting authorities. The aim of this thesis is to give an explanation of the links between the legal regulations of these contracts, in which the problems associated with these uncertainties lie and, on this basis, submit proposals for possible solutions to the given issue. The theoretical part of the thesis explains the basic concepts such as the contracting authority or the concept of public support within the EU. In this section there are also mentioned the formal and material sources of law related to the examined topic and the interconnection of the national legislation is explained. The practical part is devoted to the impact of ambiguity in the legal regulations of procurement in the Czech Republic, ie possible sanctions, in case of any of the errors made by the contracting authority, when these facts are demonstrated on actual cases. At the end of the thesis there are outlined the potential starting points for avoiding the negative consequences of wrongly processed and subsequently implemented public procurement, which was supported by EU funds.
