The Principles of Tax Proceedings

Abstract:

Hlavním cílem a obsahem bakalářské práce je popis vybraných zásad daňového řízení a jejich porovnání jak z pohledu zákona o správě daní a poplatků, tak i nového daňového řádu. V části práce jsem se také zaměřil na správní řád, a jeho diskutované použití v daňovém řízení. Rozeberu a objasním pojmy typické pro daňového řízení. Jedná se o pojmy daň, správce daně, daňový subjekt, správa daní a daňové řízení. Popíši je z pohledu, jak zákona o správě daní a poplatků, tak i nového daňového řádu. Pro obsah práce bude přínosem i aktuální otázka daňového řádu, který jak již bylo řečeno zcela nahradí stávající zákon o správě daní a poplatků. Dále se zaměřím obecně na zásady jednotlivých právních úprav. Tedy zásady dle již zmiňovaného zákona o správě daní a poplatků a daňového řádu a zásady dle správního řádu. Budu se lehce zabývat úvahou, zda je nebo není možné použití správního řádu v daňovém řízení. Nakonec se zaměřím na popis jednotlivých zásad, které mi připadají pro daňové řízení důležité a zajímavé.

Abstract:

The main target and subject of bachelor’s thesis is description of the representative principles and their comparison both from the point of view of law of administration of taxis and tariffs and new Tax Code. The part of thesis is focussed on the Executive Code and its discussed using in the taxation proceedings. I find very important to analyse and to make clear in the preamble the concepts typical for the taxation proceedings. It concerns the concepts as are the tax, the tax administrator, the tax subject, the administration of taxes and the taxation proceedings. I will describe them from the point of view both the law of Administration of Taxes and Tariffs and the new Tax Code. The actual question of the Tax Code will be the benefit for the work subject. As it has been said the Tax Code will fully substitute the present code of Administration of Taxes and Tariffs. I will focus in general on the principles of separate legal regulations, it means on the principles according to the mentioned Code of Administration of Taxes and the Tax Code and the principles according the Executive Code. I will focus on the subscription of separate principles that are in my opinion interesting and significant for taxation proceedings.
