Punishment of imprisonment with a focus on its imposition and conditional release from its execution

Abstract:

This thesis is focused on theoretical research, which results in a critical evaluation of the legal setting of conditions for the imposition of a punishment of imprison-ment and for conditional release from its execution. I focus on a closer analysis, understanding and pointing out the key aspects that the general courts should ad-here to and evaluate in their considerations at the moment of decision. The intro-ductory part of the thesis is devoted to the issue of the right to personal freedom, its importance in the domestic and international legal fields, its limitation as well as its deprivation by imprisonment after conviction by the relevant court. In the second part if the thesis, I deal with the issue if imposing a punishment of imprisonment. The thesis presents and discusses the individual components of the possibility of legal imprisonment of a person after conviction by the relevant court in criminal procedure, which was carried out by established law. The last part deals with the institution of conditional release from imprisonment. First of all, it presents a theo-retical introduction to the issue, then the legal conditions for the conditional release of the convicted person from serving a sentence and the court’s consideration of the possibility of such a conditional release are analyzed. It is also pointed out the selected issues of the conditional release. In conclusion, the thesis describes the general findings of the performed analysis and also presets considerations de lege ferenda, which could lead to the elimination of identified deficiencies either in the legal regulation or in the practical judicial sphere.

Abstract:

Dizertačná práca je zameraná na teoretický výskum, ktorý vyúsťuje v kritické zhodnotenie zákonného nastavenia podmienok pre ukladanie nepodmienečného trestu odňatia slobody a pre podmienečné prepustenie z jeho výkonu. Zameriavam sa na bližšiu analýzu, pochopenie a poukázanie na kľúčové aspekty, ktorých by sa mali všeobecné súdy držať a hodnotiť ich vo svojich úvahách v momente rozhodovania. Úvodná časť práce je ponechaná problematike práva na osobnú slobodu, jeho významu vo vnútroštátnom, ale aj medzinárodnom právnom poli, jeho obmedzeniu ako aj zbaveniu uväznením po odsúdení príslušným súdom. V druhej časti práce sa venujem otázke ukladania nepodmienečného trestu odňatia slobody. Práca prezentuje a rozoberá jednotlivé zložky možnosti zákonného uväznenia osoby po odsúdení príslušným súdom v trestnom konaní, ktoré bolo uskutočnené v súlade so zákonom. Posledná časť sa zaoberá inštitútom podmienečného prepustenia z výkonu trestu odňatia slobody. V prvom rade predstavuje teoretický úvod do danej problematiky, následne sú rozobrané zákonné podmienky podmienečného prepustenia odsúdeného z výkonu trestu a uváženie súdu o možnosti takéhoto podmienečného prepustenia. Poukázané je aj na vybrané otázky inštitútu podmienečného prepustenia z výkonu trestu odňatia slobody. Záverom sú v dizertačnej práci popísané všeobecné zistenia vykonanej kritickej analýzy a taktiež sú predstavené úvahy de lege ferenda, ktoré by mohli viesť k odstráneniu zistených nedostatkov či už v zákonnej úprave alebo v praktickej justičnej sfére.
